Dodge Ram Gas Guzzling Class Action Lawsuit Overview: 

  • Who: FCA US LLC and Cummins Inc have asked a judge to reject certifying a class action lawsuit lodged by Dodge Ram owners. 
  • Why: FCA and Cummins claim the truck owners who claim their vehicles consume excess amounts of fuel rely on last minute and unproven theories in an effort to achieve Class certification.
  • Where: The class action lawsuit is pending in Michigan federal court.

Dodge truck owners who claim in a class action lawsuit they overpaid for gas guzzling vehicles are facing arguments by Fiat Chrysler (FCA) and engine manufacturer Cummins Inc against Class certification. 

FCA argues the drivers don’t have proof they overpaid for the vehicles and are using last-minute and unproven theories to try and achieve Class certification. 

The automaker points specifically to drivers’ new claims that the Dodge Ram trucks contain an “excessive emissions device” — something it argues does not exist.

“Having abandoned their pleaded theory of a ‘defeat device,’ Plaintiffs now rely on a theory the Class Trucks are equipped with a ‘device’ they contrived out of thin air,” FCA said. 

Dodge Ram Trucks Falsely Advertised, Claims Class Action Lawsuit

Drivers claim the Dodge Ram trucks they purchased were rigged to use excessive amounts of fuel and emitted an illegal amount of pollutants.

Further, drivers allege the companies committed breach of contract and violated the Racketeer Influenced and Corrupt Organizations Act.

FCA, meanwhile, argues a number of factors influence a drivers’ decision to purchase a Dodge Ram truck and that there is no way to separate how to calculate “overpayment” for a used vehicle versus a new one. 

“Plaintiffs were not exposed to the same amount or type of advertising, they had different Monroney labels on their trucks, they held varying views on the importance of emissions in deciding to buy, and they (had) different beliefs as to whether their trucks meet represented and expected fuel economy,” FCA said. 

In addition to the excessive fuel usage claims, drivers are arguing they paid extra for features associated with clean vehicles and were continually harmed by problems such as excessive soot accumulation. 

Drivers also argue that the vehicles were designed to operate differently during regulator tests than during real world driving conditions. 

A separate class action lawsuit was filed against FCA last month by drivers who allege they overpaid for Dodge muscle cars built with rear differentials that are prone to exploding.

    I have been reporting the MPG issue to the local ram dealership and even their own technicians could not achieve the advertised MPG. I’m already un litigation with Strategic Legal practices and they are pursuing other problems such as a broken visor, defective USB hub and nany more but I wish I could join your Class action suit

    2021 Ram 1500 with etorque, I average 11 to 12 mpg and I drive like a grandma. The window sticker said 20 city 26 highway.

    2020 ram 1500 limited w/etorque. No check engine lights just 12.5 mpg highway better in the city due to the eco mode will hold. I moved from diesel to this model to improve from the 12 mpg my diesel was consistently getting.
