Mercedes-Benz Defective Sunroof Class Action Lawsuit Overview:
- Who: Bruce Pickens filed a class action lawsuit against Mercedes-Benz.
- Why: The plaintiff alleged the sunroof in his Mercedes-Benz car spontaneously shattered.
- Where: The class action lawsuit was filed in Illinois federal court.
An Illinois judge has dismissed a class action lawsuit claiming the sunroofs in Mercedes-Benz vehicles can crack and explode during driving, possibly injuring occupants.
U.S. District Judge Thomas M. Durkin said none of the 21 claims Lead Plaintiff Bruce Pickens made were adequately pleaded. The court has now refused to give him leave to prepare a third amended complaint.
“Pickens has already amended his complaint twice,” the judge said. “Pickens has had sufficient opportunity to state and amend his claims, so his complaint is now dismissed with prejudice.”
One of the flaws in the complaint is that Pickens suffered emotional distress due to the incident. However, he was not driving the car at the time the glass shattered.
“Pickens’ sister is not plaintiff in this case, and Pickens does not have standing to recover for his sister’s alleged distress,” the lawsuit states.
Pickens also claimed many vehicle owners have had the same problem with their sunroofs and that Mercedes-Benz was aware of the defect. He cited a National Highway Traffic Safety Administration recall notice on sunroofs.
“But that notice does not address the shattering sunroof windows or the car model Pickens
purchased, and, in any case, it was issued after Pickens bought his car, and so is not evidence that Mercedes had such knowledge at the time of sale,” the judge said.
