wayfair bedA Wayfair class action lawsuit claims that consumers were exposed to bed bugs in infested headboards and mattresses knowingly sold and shipped by the company.

The Wayfair class action lawsuit says the online retailer continued to sell infested furniture items to consumers despite their knowledge of the bed bug infestation.

The lead plaintiff argues that the company did nothing to eradicate the bed bugs or to warn consumers about the problem, ultimately selling the affected items for two years after the defendant became aware of the problem.

The Wayfair bed bug class action lawsuit also states that the infested items are still for sale.

As pointed out in the Wayfair class action lawsuit, bed bugs are insects that feed on human blood.

These bugs can be located in bed frame cracks, in loose wallpaper, or even behind picture frames.

Anyone whose home or furniture becomes infested with bed bugs requires comprehensive fumigation and possible destruction of the contaminated furniture.

The Wayfair bed class action lawsuit also alleges that any buyer who has had to cope with bed bugs deals with social stigma and lost sleep.

The Wayfair class action lawsuit says that bed bugs, which were a surprise to consumers who purchased headboards and mattresses from Wayfair, became the buyer’s problem even though Wayfair knew about the issue as early as 2016.

The lead plaintiff in that Wayfair class action lawsuit turns to online reviews and comments about affected products, including fabric headboards.

Those reviews indicate that consumers across the country not only experienced bed bugs upon arrival of their new furniture piece, but that Wayfair was contacted in these cases and therefore knew about the problem.

In their online reviews and complaints, many of these consumers state that even when Wayfair offered a refund that the consumer still had to fumigate their entire home.

Bed bugs are difficult to identify until they have begun their feeding cycle, but can infest an entire home if the resident does not catch the problem quickly.

The plaintiff in the Wayfair class action lawsuit says he notified the company as soon as he discovered bed bugs. He received an apology and a 10 percent off coupon for a future order in response.

The Wayfair bed bugs class action lawsuit alleges that the company had plenty of reason to believe that certain headboards and other bedding items were infested with bed bugs due to the volume of consumer calls and complaints.

However, the Wayfair class action lawsuit says the company failed to disclose the risk of bed bugs or hire exterminators to treat the furniture, forcing the consumer to cope with this problem and bear the costs.

The Wayfair class action lawsuit seeks to represent a nationwide Class, an Illinois Class, and a consumer fraud multi-state Class of buyers who obtained any bed component from Wayfair that was infested with bed bugs.

The Wayfair class action lawsuit seeks injunctive relief, declaratory judgment, attorneys’ fees, actual damages, profit disgorgements, damages, and restitution associated with allegedly deceptive business practices surrounding the sale of headboards, mattresses, and bed frames.

The plaintiffs are represented by Katrina Carroll, Kyle A. Shamberg, and Nicholas R. Lange of Lite DePalma Greenberg LLC and Tiffany M. Yiatras of Consumer Protection Legal LLC.

The Wayfair Bed Bugs Class Action Lawsuit is Ronald Gorny v. Wayfair Inc., Case No. 1:18-cv-08259, in the U.S. District Court for the Northern District of Illinois.

This happened to me in November 2016 — when I was juggling a two month old baby. I easily spent more than 80 hours since I had to take about two weeks off of work so I could clean out my large house for treatment for the infestation that occurred in my Wayfair / Joss & Main tufted headboard. We had to cancel my son’s baptism and friends traveling into town that month, not to mention a lot of sleep lost and dermatology appointments in the months leading up to the discovery. Wayfair agreed to reimburse us for the headboard, but they refused to pay for the thousands of dollars lost to the pest control company and so much lost clothes and home goods that didn’t survive the heating treatment. I’m still angry three years later and I have all the proof of photos and documents and invoices.

Yes!! I ordered bedding from them for my new home. within three weeks I was having issues at my new home! I have had to treat my home three separate times. Hopefully they are finally gone! Add me!

I also just purchased one in Dec.2018. I just shipped it back today 1/29/2019.. Upset at the thought of bedbugs and angry that they are still selling them.

Also it cost me money to return it.

How do I get in on class action, I bought a headboard and have been fighting these bed bugs for weeks, I couldn’t figure out where they came from until I saw one climbing out of my headboard! That’s when I looked up complaints from wayfair

  4. Emily says:

We were also affected. Purchased in June 2017. Contacted the company and was offered a refund but still had to dispose of a mattress set, plus the cost of eradicating the problem.

  5. Crystal says:

I don’t know, and don’t mean to accuse, but knowing what I know about bed bugs (my dad owns a pet control business here in Ga), as well as my experience irradicating from my own home here in Ga, I can’t help but feel like somebody is either lying and looking for someone to blame and reimburse them for the cost of dealing with the bedbugs, or they already had them and didn’t know it, and within hours of setting up their new headboards, they too became infested. Bed bugs are attracted to warmth, and the carbon dioxide that we exhale. These two components = blood to the bed bug, so with that being said, these guys don’t just hang out or live on beds or bed components that humans dont also frequent. I just dont believe that these bugs, while very illusive and master hitch hikers, conspired in a Wayfair warehouse somewhere in China or Mexico, and figured out how to escape death by starvation, by waiting on some unsuspecting American to purchase the headboard in which they would be hiding. That’s ludacris. People do these kinds of things. Bed Bugs do not. The only way this could be true is if the furniture Wayfair is selling has been used. I like to think that people are generally good, and that it’s more likely that they already had them and didn’t know it, until they brought in a bed bugs dream home, (or upholstered headboard). Lots and lots of places to hide, and only inches from their food source. Oh well, good luck Wayfair.

    1. Stephanie Phelps says:

When bedbugs are not within distance of a carbon-dioxide-exhaling meal for a period of time, they go into a hibernation-like, dormant state. They can live like this for over a year without a blood meal; becoming active again only when they sense another source of food. I have no doubt that the furniture could’ve caused people infestations. I went through a situation much the same afterordering a baby bed rail from Amazon at a discounted cost due to the box having had been opened, although the product was new. Probably a return I assume. Amazon was no help when I called about the issue either; promising an investigator would call me within 2 days although I never heard a word back. It cost over $2000 to get my house heat treated, not to mention the hassle, time off of work, cost of a new mattress, etc. A complete nightmare. Hitchhikers they are, don’t underestimate in how many ways that is true! Upon closer examination of the box and material part of that bed rail, I noticed the telltale black dots, a sign of bed bugs feces in the corner creveces by the zipper. I just wish I had did my investigation of the item and known then what I later learned about bed bugs, before using it and in-turn getting bed bugs. It was a horrible experience, one I would not wish on my worst enemy. I wish someone would file a class action lawsuit against Amazon for the same thing. I live with my mother and I’m a stay-at-home mom, so needless to say this extremely expensive and unfair cost landed on her, because what choice do we have?

Yes. I got it in storage

Forgive me for using your ad again. A voice. Who knew? For everyone reading this. As you venture out today to work, restuarants, Doctors offices, Hosptals ect. Thousands of people have sat in those cloth chairs before you. Dust mights, bed bugs and disease can be on or trapped in the fabrics. Can one place of bussiness say they have there cloth seats steam cleaned daily? I don’t think so? I have stood in my medical offices and other businesses for years. Please remove your clothes before sitting on your own furniture. Thank you for vinyl and leather. Thank you and God Bless you.

  8. Rene says:

I was a first time buyer at wayfair or any other company on line. I purchased a fabric headboard in Dec. 2018. Being a Let’s say skeptic on everything, I did my research before doing so. When revieved a couple days later. I opened box outside. And let it air out. It was wrapped and boxed perfectly. I sprayed with disinfectant being it was made outside this country. It is perfect and no bugs attached! Different designer may have shipped from different location. Oh and this is first time commenting on anything. Good luck Wayfair

  9. YOLANDA HYCHE says:

I purchased a new fabric headboard from Wayfair. I couldn’t understand what was going on. I thought I was crazy. Threw away my living room furniture and bed.

  10. Lee says:

We recently purchased a fabric headboard in Dec2018 are these included?
