wayfair bedA Wayfair class action lawsuit claims that consumers were exposed to bed bugs in infested headboards and mattresses knowingly sold and shipped by the company.

The Wayfair class action lawsuit says the online retailer continued to sell infested furniture items to consumers despite their knowledge of the bed bug infestation.

The lead plaintiff argues that the company did nothing to eradicate the bed bugs or to warn consumers about the problem, ultimately selling the affected items for two years after the defendant became aware of the problem.

The Wayfair bed bug class action lawsuit also states that the infested items are still for sale.

As pointed out in the Wayfair class action lawsuit, bed bugs are insects that feed on human blood.

These bugs can be located in bed frame cracks, in loose wallpaper, or even behind picture frames.

Anyone whose home or furniture becomes infested with bed bugs requires comprehensive fumigation and possible destruction of the contaminated furniture.

The Wayfair bed class action lawsuit also alleges that any buyer who has had to cope with bed bugs deals with social stigma and lost sleep.

The Wayfair class action lawsuit says that bed bugs, which were a surprise to consumers who purchased headboards and mattresses from Wayfair, became the buyer’s problem even though Wayfair knew about the issue as early as 2016.

The lead plaintiff in that Wayfair class action lawsuit turns to online reviews and comments about affected products, including fabric headboards.

Those reviews indicate that consumers across the country not only experienced bed bugs upon arrival of their new furniture piece, but that Wayfair was contacted in these cases and therefore knew about the problem.

In their online reviews and complaints, many of these consumers state that even when Wayfair offered a refund that the consumer still had to fumigate their entire home.

Bed bugs are difficult to identify until they have begun their feeding cycle, but can infest an entire home if the resident does not catch the problem quickly.

The plaintiff in the Wayfair class action lawsuit says he notified the company as soon as he discovered bed bugs. He received an apology and a 10 percent off coupon for a future order in response.

The Wayfair bed bugs class action lawsuit alleges that the company had plenty of reason to believe that certain headboards and other bedding items were infested with bed bugs due to the volume of consumer calls and complaints.

However, the Wayfair class action lawsuit says the company failed to disclose the risk of bed bugs or hire exterminators to treat the furniture, forcing the consumer to cope with this problem and bear the costs.

The Wayfair class action lawsuit seeks to represent a nationwide Class, an Illinois Class, and a consumer fraud multi-state Class of buyers who obtained any bed component from Wayfair that was infested with bed bugs.

The Wayfair class action lawsuit seeks injunctive relief, declaratory judgment, attorneys’ fees, actual damages, profit disgorgements, damages, and restitution associated with allegedly deceptive business practices surrounding the sale of headboards, mattresses, and bed frames.

The plaintiffs are represented by Katrina Carroll, Kyle A. Shamberg, and Nicholas R. Lange of Lite DePalma Greenberg LLC and Tiffany M. Yiatras of Consumer Protection Legal LLC.

    I bought the Avril headboard in april 2021 and did not realize the source of the bug infestation until two week ago after throwing out my mattress carpeting and a few other items ” just in case”!.. ….never did I expect to receive a bug infested headboard from wayfair so it took me longer than you to figure out where the “monsters” were coming from .. it’s also surprising to think you would make the statement that bed bugs don’t take right months to be discovered as if all “bed bugs” receive a pamphlet informing them of the time limit allowed “bed bugs” to hide undetected before having to come out of the shadows …..
    .. are you negating the possibility of people with different circumstances or situations which you may think are embellished or untruthful… who would even admit to “bed bug tenants” infesting their home if it were not true…? I wouldn’t… I really really really wouldn’t….

    A year and a half ago I bought 3 mattresses and I was getting bite marks and they hurt like hell we had bed bugs so bad it was just awful it not a fight it’s a war you have to fight to get rid of these it was just awful well let me tell you we finally did win the war on bed bugs . I tell you I order everything from Wayfair I mean everything now I’m gonna have to stop they just lost slot of money !!!!!!

    There can not be any Wayfair class action lawsuit, sadly. My uncle bought a headboard from Wayfair in 2019 and he just had to get it thrown out because it was infested with thousands of bedbugs. Here’s the catch:

    Wayfair’s Terms of Use have a MANDATORY ARBITRATION clause in there. Anything you buy on there is subject to arbitration AND you forfeit your right to join a class-action lawsuit. That is why this case and the one that came before it were stayed and dismissed with prejudice. . . .

    Until Mandatory Arbitration clauses are deemed illegal for consumer products, this disgusting practice will only continue. Wayfair probably still sells bedbug-infested headboards to this very day!

      Yes they do and we purchased in 2021 we have a claim against Wayfair we are waiting horribly they are aware that they are selling bed bugs infested with bugs so sad a company can practice this way

      We just discovered an infestation inside a fabric headboard my daughter ordered from Walmart about 10 months ago. She had what looked like a horrible rash and we could t figure out what was causing it until she felt rhem on her last night. Needless to say we threw the whole thing out. It is horrible that these big money companies are knowingly selling this crap.

        I been having infestation headboard after one month of purchase. Bought headboard bed frame through wayfarer last year and my mattress and all furniture gone. I never had bed bugs and I though it was just allergies that was going on. But makes sense now.

    I am an exterminator. If you purchase a brand new bed and get bed bugs you are not entitled to a free bed. Purely coincidence. Stop looking for someone to blame for an act of god.

      Bill,

      This is no act of god. This is a company that has knowledge (has had knowledge for years) that its products possibly contain bedbugs when they come in from overseas. They buy these products from other companies in China and then ship them off to unsuspecting consumers in the United States.

      The only reason that you haven’t heard more about this is because there is a MANDATORY ARBITRATION CLAUSE on Wayfair’s websites. Most lawyers worth their weight in salt probably won’t even take up these cases because of the mandatory arbitration clause. Filing a lawsuit is a waste of the consumer’s money and of the lawyer’s time.

      Given this fact that filing a lawsuit is useless. . . there are probably hundreds or thousands of headboards sold by Wayfair over the last 5 years that are infested with bedbugs.

      We need congress to strike down mandatory arbitration clauses for consumer products.

        I too found them peeking out from behind the buttons on a tufted headboard I bought from Wayfair. I am using my vacation to throw out things I have worked hard for. I am 71 and doing this by myself. It is exhausting. God help us .

      Really?????? Unbelievable when a company is aware of the issue they should not be selling anything infested with bugs just like you should not buy a tv that does not work are you kidding me the company knows they are infested with bed bugs they should advertise that they are when they sell otherwise that is false advertisement as well as putting in danger that have health issues and allergic. So get knowledgeable before you make any statements. please

      Bill when a company knows the beds they are selling to unsuspecting consumers, it’s their fault not the consumers would you like to buy a car that the brakes sometimes don’t work and the dealer who sold you the car knew that the brakes sometimes did not work is that what you paid for when you didn’t know at the time of purchase and it wasn’t disclosed to you. If Wayfair advertised or put in the description that it is very possible you can have bedbugs infest your entire home by this purchase then it would be the consumers discretion to purchase but Wayfair did and does not disclose this. Your a foolish exterminator .

      bill, where have you been living… of course it’s possible to buy something new and receive it with an infestation of bugs… that’s very narrow minded to refuse the possibility of it happening… it happened to me as well with consequences that were devestating…

    Eddahbi Fremont Upholstered Platform Bed by Ebern Designs- Bought this platform bed from wayfair.

    After a month realized the problem after suffering lot of bites and itchiness. After closer inspection we saw bed bugs /eggs etc. Letting wayfair know they refunded the money ….. i had to return the bed i had bough along with it for the scare of infestation . Other rooms in my home also seem to be infested

    I had decided to treat myself to a new bedframe since mine was too small for my new mattress. Within 3 months of purchasing my new headboard from Wayfair I was infested with bedbugs and nothing else had been brought into my home and I do not travel so there’s no other way I could have gotten them. I’m really upset since I have to pay hundreds for exterminators and may have to buy a new bed and mattress.

    I bought a couch from all modern last October. I believe the bugs have been dormant and now have been feeding. there is blood all over my sheets (it’s a convertible couch to futon). There is no other way I could have gotten bed bugs. I’m horrified.
