A class action lawsuit has been filed following a bed frame collapsing defect.

A bed frame sold by national retail store Mattress Firm randomly collapses due to a design defect, posing crushing hazard that could result in severe injury or death, according to a new class action lawsuit.

A national class action was filed in the Southern District of New York on April 8 by lead Plaintiff Antonio Payero, alleging that Mattress Firm had knowingly sold and profited off of its “unreasonably dangerous” Bed Tech HR Platform bed frames.

Payero said that he bought two of the $200 HR Platform bed frames in spring 2020 from a Mattress Firm outlet in New York. Not long after purchasing the frames, Payero said that the legs of the bed frames began to fold in, causing the mattress to collapse in the middle, alleges the class action.

“A bed frame that poses such a hazard is unreasonably dangerous considering the prone position of the users laying on top of the bed frame and the fact Product can collapse at any time,” the class action claims, adding that collapse could result in severe injury or death.

Payero alleges in the lawsuit that Mattress Firm was aware of the defect, but continued to sell the bed frames and profit from its failure to disclose the defect. Payero says in the lawsuit that had he known about the defect, he would not have purchased the frames.

In March, more than 80,000 HR Platform bed frames were recalled after the company received 100 reports of the product collapsing. Fortunately, no injuries were reported at the time. The recall included the following model numbers: HR33, HR33XL, HR46, HR50, HR60, and HR66.  

The CSPC notice said that consumers should immediately stop using the recalled HR Platform Frames and reach out to Global Home Imports to receive a free repair kit with metal clips to strengthen the frame.

However, the class action lawsuit notes that no financial compensation was offered to consumers.

“The recall remedy was grossly insufficient because it in no way compensated consumers for the purchase of a dangerous and defective product,” the class action alleges.

Payero seeks to represent anyone in the US who purchased one of the HR Platform bed frames and a subclass of New York-based buyers.

Payero is suing for violation of business laws, fraudulent omission, unjust enrichment, and breach of warranty. He seeks classification of the Class, damages, interest, legal fees, and a jury trial.

It’s not only bed frames threatening a peaceful night’s sleep. In March, a class action lawsuit was filed against mattress company Zinus, with plaintiffs claiming that the mattress could open and release hazardous glass fibers.

Plaintiffs Amanda Chandler and Robert Durham say that once the outer cover of the said mattresses are unzipped, large glass fibers can spill out, causing serious injuries and property damage.

    Please add me. I bought one of the recalled frames in September 2020 from Mattress Firm. They refuse to give me a refund or axchange.. I am sleeping on the floor because I cant afford a new frame.

    Please add me. I purchased mattress and box springs, frame from Mattress Firm within a few months it had a big deep hole in the middle. They did nothing for me when I informed them of the faulty product.
