Organic Valley dairy cow humane treatment class action lawsuit overview: 

  • Who: Amber Takahashi-Mendoza filed a class action lawsuit against farmer-owned cooperative Organic Valley.
  • Why: Takahashi-Mendoza claims Organic Valley misleads consumers into believing it treats its dairy animals humanely, arguing it is not actually the case. 
  • Where: The class action lawsuit was filed in the Superior Court of California. 

Organic Valley misrepresents that it produces its dairy products with a higher standard of animal care than what is actually true, a new class action lawsuit alleges. 

Plaintiff Amber Takahashi-Mendoza claims Organic Valley prematurely separates calves from their mothers during the dairy-making process, deceiving consumers who believe labeling stating that the company treats dairy cows “with love.” 

Takashi-Mendoza argues she paid more to purchase Organic Valley’s dairy products since she believed she was supporting a business which — according to the company’s representations — treated their dairy animals humanely, the Organic Valley class action states.  

Further, Takahashi-Mendoza claims Organic Valley does not give the newborn calves adequate milk for natural sustenance or allow them to socialize before they reach an age when they can get pregnant and begin producing milk. 

Takahashi-Mendoza wants to represent a California class of consumers who purchased Organic Valley products the company represented as being produced with high animal care standards, according to the Organic Valley class action.  

Organic Valley class action alleges company’s  treatment of dairy cows ‘not humane’

The People for the Ethical Treatment of Animals (PETA) Foundation is part of the counsel for Takahashi-Mendoza, who argues Organic Valley’s alleged mistreatment of its dairy cows is “not humane.” 

Organic Valley allegedly misrepresents how it treats its cows in an effort to capitalize on a growing desire from dairy customers to do business with companies that treat their dairy animals humanely, the Organic Valley class action alleges. 

Takahashi-Mendoza claims Organic Valley is in violation of California’s Legal Remedies Act and Unfair Competition Law. She demands a jury trial and requesting declaratory and injunctive relief.

A similar complaint made progress toward resolution last month after milk company Fairlife and its parent company Coca-Cola agreed to pay $21 million to end claims they misled consumers about the way they treated their dairy cows

And in 2020, Ben & Jerry’s sought the dismissal of a class action lawsuit accusing the company of sourcing the dairy for its products from factory farms, contradicting its statement that the dairy comes from “happy cows.”
