Walmart class action claims Great Value chia seeds contain mold

A new class action lawsuit claims Walmart’s Great Value chia seeds contain undeclared mold and yeast.

Plaintiff Nicholis Palmier filed the class action complaint against Walmart on June 29 in Florida federal court, alleging violations of state consumer laws.

Palmier claims he purchased the Great Value chia seeds from a Walmart Supercenter in Homestead, Florida, after reviewing the advertising claims on the packaging and labeling.

Palmier says he relied on Walmart’s representations and would not have purchased the product if he had known it was adulterated.

As a result, Palmier claims he and other consumers paid a premium for a product that was not as advertised, and he is seeking to represent anyone in the United States who bought Walmart’s Great Value Organic Chia Seeds during the class period.

Independent tests revealed high levels of mold, class action alleges

According to the class action lawsuit, independent testing by ConsumerLab.com reportedly found that Walmart’s Great Value Organic Chia Seeds contained eight times the allowable level of mold, with 8,000 colony-forming units (CFU) per gram compared to the 1,000 CFU/g limit set by the United States Pharmacopeia for botanical products.

Palmier claims the mold was not visible on the product but grew from samples, indicating spoilage. He alleges Walmart failed to disclose the presence of mold and yeast on the packaging, leading consumers to believe they were purchasing a safe and uncontaminated product.

The class action lawsuit argues that the presence of mold and yeast in the Great Value chia seeds could lead to serious adverse health consequences.

Palmier claims he and other consumers would not have purchased the product or paid as much for it if they had known about the contamination.

The lawsuit is suing for violations of Florida’s Deceptive and Unfair Trade Practices Act, breaches of express and implied warranties, negligent misrepresentation and unjust enrichment.

He is seeking certification of the Walmart class action, damages, fees, costs and a jury trial.

In other legal action against Walmart, consumers are suing the company for allegedly enriching itself by keeping money it collected from customers to offset tariffs that were later deemed illegal.
