Toyota RAV4 Fuel Capacity Texas Class Action Settlement Overview:

  • Who: Drivers with certain 2019, 2020 and 2021 RAV4 Hybrid vehicles have reached a class action settlement with Toyota.
  • Why: The drivers allege Toyota advertises the cars have 14.5-gallon fuel tanks but actually only hold 10 gallons. Toyota has reached a settlement to end the claims in this case.
  • Where: The drivers represent a nationwide class.

Toyota has reached a deal with a group of drivers that alleges certain Toyota 2019, 2020 and 2021 RAV4 Hybrid vehicles are advertised as having 14.5-gallon fuel tanks when owners can only add 10 gallons to the tank.

The automaker has agreed, as part of the settlement, to provide an Extended Customer Support Program to all eligible class members, including free repair of the fuel tank issue, Legal Scoops reports.

The settlement comes after drivers first sued Toyota Motor Sales in a Texas federal court Feb. 13, 2020.

The drivers alleged that Toyota advertises the fuel tank in certain RAV4 Hybrid vehicles as having a capacity of 14.5 gallons and a range of 580 miles. However, even when nearly empty, owners cannot add over 10 gallons of fuel before the automatic shut-off engages and stops the pump from filling the tank further, they claimed.

The case was originally brought on behalf of a class of owners and lessees of certain 2019, 2020 and 2021 Toyota RAV4 Hybrid vehicles and 2021 RAV4 Prime vehicles who live in Missouri and California but was recently amended to include owners of all such cars nationwide.

Other Toyota Lawsuits Regarding Fuel Tank Capacity Continue

Despite this settlement, the deal does not resolve or provide a release for claims related to the actual capacity of the vehicles’ fuel tanks. Those claims are still being examined in the courts, through another class action lawsuit filed in a California federal court

The plaintiffs in that case filed objections to the above settlement to ensure the settlement does not challenge claims of the actual fuel tank capacity of those vehicles asserted in the California case.

Under the settlement, Toyota will offer an Extended Customer Support Program to all class members who believe that their fuel tank experiences the fuel tank capacity issue. 

Plaintiffs will get free inspections of the fuel tank and fuel sender gauge unit and a free repair if a problem exists. They will also get a free loan vehicle if necessary. 

The program will also increase the original Customer Support Program by seven years and 50,000 miles for a total coverage period of 15 years from the date the vehicle was initially sold/leased or 150,000 miles, whichever occurs first, on original parts.

Toyota will also pay fees, costs, expenses and awards to named plaintiffs.

    My 2021 Rav4 Hybrid can only take no more then 10.5 gal. When it shows 1/4 tank and shows 79 miles to empty. Took picture of Guages. Also took to dealer Heritage Toyota Harrisburg Pa. and they said not on recall list and nothing they could do.

    I’ve got the same issue on my 2020 Rav4 Hybrid. Have yet to fill more than 10 gallons when it reads empty. So, even with a 2 gallon reserve – what about the other 2.5. gallons? Frustrating as one of the reasons I bought this car was to not have to stop and fill up tank so much.

    I bought a 2019 RAV4 Hybrid limited used in early 2021. I soon learned first hand about the tank issue. I called Toyota corporate and they gave me a ‘claim #’, which I gave to the Plano,Tx Toyota dealer and the dealer promptly set up date to repair and did so satisfactorily in one day, and rental provided! I was impressed. My Rav now reads about 500 gallons when full and was advised the ’emergency tank’ is about 2 full gallons – so I am pleased how well everyone responded and assisted me in solving the issue..

    2020 RAV 4 hybrid limited. Have this issue as well, took to the dealership to get the tank and stuff replaced, but still only get about 10 gallons and then need to fuel up again.

    2021 RAV 4 XLE Hybrid: I’ve tracked the issue numerous times and my tank tops out at 12.5 g after driving a bit after the low fuel warning light turns on. I had brought the issue up with the original dealer with 2 months of purchasing the vehicle (10-31-20), and they finally notified me that they had recommended action (May 2021). Disappointed.

      I’m having this exact same problem! My dealership told me that there is a 2 gallon reserve and that is why it is doing this. I don’t believe them!

      Same for me. The most 10.8 for the rav4 prime. Dealer is stating the rest is “on reserve”.

    I purchased a Rav4 hybrid in 2019 my car is one of those with the recall , despite from the dealer switching the part my car is still working the same as before so the new part is not working properly and I am not getting the 14.5 gallon capacity they stated I was going to get .
    They had diagnose the vehicle many times and they state the car is fun this is not , I created a claim with BBB and also complained to costumer service and they haven’t reached me I am in need of legal help against them .
