Current and former owners and lessees of certain Mercedes-Benz and Sprinter BlueTEC vehicles may qualify to claim thousands of dollars thanks to Mercedes emissions class action settlement agreements with the carmaker and supplier Bosch totaling more than $789 million

The Class is made up of all current and former owner or lessees of subject vehicles who, on or before Sept. 14, 2020, owned or leased and registered a subject vehicle or who, after Sept. 14, 2020, began owning or leasing and registered a subject vehicle for which an approved emission modifications (AEM) has not been installed.

Also included are dealers and resellers who meet the Class definition.

The following Mercedes BlueTEC vehicles are subject to the Mercedes emissions settlement:

  • E250 (2014-2016)
  • E350 (2011-2013)
  • GL320 (2009
  • GL350 (2010-2016)

Plaintiffs in the Mercedes emissions class action had alleged certain Mercedes-Benz BlueTEC vehicles were equipped with emission control systems that caused them to emit more nitrogen oxides than consumers expect and more than what is permitted under state and federal law.

They argued the defendants intentionally misled consumers.

Mercedes BlueTEC Settlement Benefits

Mercedes-Benz has agreed to pay a maximum of $726 million, while Bosch will pay $63.3 million.

Current owners and lessees who file a valid claim will receive $3,290 from the Mercedes BlueTEC settlement, plus about $300 from the Bosch settlement, plus a possible additional payment, if no former owner or lessee submits a valid claim for the same vehicle.

Alternatively, current owners or lessees of a vehicle for which a former owner or lessee submits a valid claim or the purchase or lease began after Sept. 14, 2020, are expected receive $2,467.50 from the Mercedes BlueTEC settlement and about $225 from the Bosch settlement, plus a potential additional amount.

Former owners or lessees are expected to receive $822.50 from the Mercedes settlement, plus $75 from the Bosch settlement. These payments will be divided equally among former owners and lessees who file valid claims for the same vehicle.

More information on the potential additional payments is available on the Mercedes emissions settlement website.

If an AEM is not made available by Oct. 1, 2022, Class Members may file a claim for payments ranging from $740.25 to $2,632, depending on the vehicle’s model year and on whether more than one claim is made on the vehicle, by Nov. 30, 2022.

The deadline for Class Members to exclude themselves or object to the Mercedes-Benz BlueTEC settlement is May 24, 2021.

A hearing is also scheduled for July 12, 2021.

The deadline for former owners or lessees of registered subject vehicles to file a valid claim form is July 12, 2021 (or the date of final Mercedes emissions settlement approval, if it is after July 12).

Current owners or lessees will receive a payment if the AEM is installed and a claim submitted by Oct. 1, 2022.
