Toyota 2021 RAV4 Fuel Capacity Class Action Lawsuit Overview:
- Who: Drivers with 2019-2021 RAV4 Hybrid vehicles are suing Toyota.
- What: The drivers say Toyota advertises the cars have 14.5-gallon fuel tanks but the tanks only hold 10 gallons.

Drivers of RAV4 Hybrid vehicles (2019 through 2021) say the cars’ fuel tanks have a defect that prevents them holding as much fuel as advertised, meaning more stops at the gas station, according to a class action lawsuit.
However, on Oct. 28, Toyota urged a California federal judge to throw the case out, arguing that having to stop more frequently to fill up isn’t an injury covered by law.
In the dismissal hearing, Toyota told U.S. District Judge Edward Chen that it had already rolled out a fix to the problem. The plaintiffs had alleged that, prior to the fix, vehicles advertised as having 14.5-gallon fuel tanks could actually only hold 10 gallons of gas.
In the hearing, Judge Chen mused on whether there could be damages available to the plaintiffs if Toyota’s fix was adequate.
Consumers first filed the class action lawsuit in Jan. 2020, alleging the fuel tank issue dramatically reduced their vehicles’ driving range.
They said the driving range was “a major selling point for which customers pay a premium.”
They added that while Toyota knew about the issue, it didn’t inform purchasers or leases at time of purchase.
Judge Chen took the matter under submission without issuing a ruling, Law360 reports.
The case comes as Toyota faces a similar class action lawsuit alleging it sells Toyota Highlanders, model years 2020 to 2021, without disclosing that the vehicles’ fuel systems are defective.

My RAV4 has had this problem since day one. I’m lucky if I get ten gallons. Most of the time it’s six gallons.I take long trips in mine. I specifically asked about the millage when I bought it. They said nothing about the gas tank issue. (and they knew about it)This is my first Toyota and last. I’ve always bought Hyundai’s. I paid for a vehicle with all the bells and whistles. That’s not what I got. This is false advertisement and out right lying about the vehicle. I have not gotten what I paid for and it should be fixed. This was supposed to be my last vehicle but it want be. It’s a safety hazard just to stop at places now days especially gas stations were you have to touch everything. I’m disable and have no immune system to speak of. I shouldn’t have to be making extra trips to the pump because Toyota doesn’t want to fix the issue with a recall. They care more about the bottom line than they do about there customers.
This is absolutely unacceptable. We purchased a Rav4 2020 and it has never hold up more than 11 gallons. I cannot not even begin to express my dissatisfaction with Toyota Servicing because they claim it takes 13.71 but how the hell? One day of miracle versus over a year of my and my husband fueling and it only take 10 to 11 gallons.
It does hold 14.5 gallons of gasoline. Though the gas gauge is not accurate!
