Ford roof defect class action lawsuit overview:

  • Who: Steven Beck filed a class action lawsuit against Ford Motor Company.
  • Why: Beck claims Ford knowingly sold Ford Super Duty pick-up trucks containing defective roofs susceptible to collapsing in the event of a roll-over accident.
  • Where: The class action lawsuit was filed in Michigan federal court.

Ford Motor Company knowingly sold Ford Super Duty pick-up trucks containing weak roof structures susceptible to collapsing in the event of a roll-over accident, a new class action lawsuit alleges.

Plaintiff Steven Beck claims Ford knew of the alleged issue with the roof’s of model year  1999-2016 Ford Super Duty pick-up trucks yet “did nothing to promptly warn owners and lessees.”

Beck argues that, instead of warning the vehicles’ owners and lessees about the alleged defect, Ford chose to enter into “secret settlements with crash victims to hide the deadly nature of its roof design defect.”

The class action lawsuit was filed only weeks after a jury in Georgia hit Ford with a $1.7 billion punitive damages verdict in a separate complaint alleging the company sold Super Duty pick-up trucks with defective roofs.

The funds were awarded to the family of a married couple killed after they were involved in a deadly rollover accident during which the roof of their model year 2002 F-250 Super Duty collapsed, according to the Ford class action.

Ford accused of exposing Super Duty pick-up drivers to ‘unreasonable risk of injury and death’

Beck claims the alleged defect exposes Ford Super Duty pick-up truck owners and lessees to an “unreasonable risk of injury and death if their vehicle is involved in a rollover accident.”

“This catastrophic injury and death risk is the direct result of a design defect that was known to Ford and is still unremedied by Ford,” states the Ford class action.

Beck argues that, in addition to allegedly knowingly selling unsafe vehicles, Ford also “misrepresented the vehicles’ safety, reliability, functionality, and quality” by failing to disclose the alleged defect to consumers.

“A vehicle that is knowingly designed to fail and introduce a grave risk of injury or death in a foreseeable and common type of accident is not fit for its ordinary purpose,” states the Ford class action.

Beck wants to represent a nationwide class and California subclass of consumers who have purchased or leased a model year 1999-2016 Ford Super Duty vehicle, including an F-250, F-350, F-450, and F-550.

Ford is accused of unjust enrichment and fraudulent concealment, and violating California’s Consumers Legal Remedies Act, Unfair Competition Law, and False Advertising Law, among other things.

Plaintiff is demanding a jury trial and requesting restitution, damages, costs, and disgorgement for himself and all class members.

Earlier this month, Ford initiated a recall for certain model year 2017-2020 F-Super Duty F-250, F-350, and F-450 pick-up trucks, and model year 2017-2020 Lincoln Continental vehicles over concerns that a flaw in the lenses for their rearview cameras could cause them to become cloudy

I own a 2016 f350. I have had headaches from day one. Brake issues sunroof leaks. I have taken it to a few dealers no dealer wants to touch it. One Ford dealer said its my roof supports causing sunroof to leak. Hopefully ford is held accountable

  2. Lisa Brown says:

I would like to be contacted regarding this lawsuit as my husband was just killed on 4/27/23 in a roll over accident while driving a 2006 F350 6.0 Super Duty.
