Top Class Actions viewers are starting to receive Atkins and drywall settlement checks in the mail amounting to $35.90 for the Atkins net carbs settlement and as much as $3,989.51 for the drywall antitrust settlement.

Atkins Net Carbs Class Action Settlement

The deadline to submit a claim in the Atkins net carbs class action settlement was April 27, 2020. The settlement received final approval from the court on June 26, 2020. TCA viewers report receiving settlement checks worth as much as $35.90.

Class Members included consumers who purchased Atkins products that contained sugar alcohol between Jan. 1, 2013 and January 2020. Under the terms of the settlement agreement, Class Members could claim reimbursement for the purchase of the following Atkins products:

  • Chocolate Covered Candies
  • Chocolate Peanut Candies
  • Milk Chocolate Caramel Squares
  • Peanut Butter Cups
  • Chocolate Caramel Mousse Bars

Class Members who were able to provide a receipt or other proof of purchase were able to claim 25% of the purchase price. Those who did not keep their receipts were able to claim 10% of the purchase price of products, limited to a total of $100.

The settlement stemmed from multiple Atkins net carbs class action lawsuits alleged that Atkins Nutritionals Inc. duped consumers into thinking the popular and pricey snacks and candies contained fewer net carbs.

Dieters attempt to lose weight by limiting their sugar and carb intake on the Atkins diet; however, many still crave sugary snacks. Atkins allegedly attempted to cash in on these cravings by offering a line of candies and snacks made using sugar alcohol or polypol. According to the class action lawsuits, the company failed to calculate the carbs added by this ingredient, marketing Atkins snacks as “no net carbs.”

While Atkins Nutritionals and other defendants in the class action settlement did not admit any liability, the company paid out $6.8 million to end the litigation.

Indirect Purchasers Drywall Settlement

TCA viewers report receiving checks worth as much as $3,989.51 in a drywall settlement that resolved claims that manufacturers engaged in a price-fixing scheme that artificially inflated the cost of drywall for consumers.

The deadline to file a claim in the settlement was Jan. 9, 2019 and was granted final approval on Oct. 26, 2018. Distribution of settlement awards to Class Members was not initiated until July 1, 2020, however.

Class Members included those who “indirectly” purchased drywall manufactured by various major manufacturers, as well as their subsidiaries and affiliates, in the United States between Jan. 1, 2012 and Jan. 5, 2018. “Indirect purchasers” are consumers who purchased the drywall for use and not resale. Settlement claims were limited to certain states.

The original drywall price-fixing class action lawsuit covered seven different manufacturers and was consolidated into multidistrict litigation. A handful of defendants agreed to settle claims to the tune of nearly $16 million earlier in the litigation. The remaining defendants later agreed to pay $1 million to end the class action lawsuit.

For the most part, settlement funds were distributed based on the number of valid claims submitted by Class Members. Class Members who could provide proof of purchase could claim their full purchase amount. Those without proof could submit a claim based on the number of drywall sheets they purchased limited to a total claim of $100.

Payments were limited to Class Members who could make claims of $50 or more.

      Don’t get your hopes up! I was sent an approval letter that said I was approved and would receive a check for 100 dollars. I called every month, was told, “Yes, Ms, you are in the system, I see your valid claim on my screen. Just be patient.” Nine months later I call and was told, ” I’m sorry you received a leter stating that you were approved but that was a mistake, you never should have been given an approval leter, sorry for the misunderstanding, but please disregard the letter.” I told the lady how I am pregnant, have two kids already, and live in Sec8 and was counting on that to pay my light bill. She said all she could do was pass my number on to her supervisor and they would contact me with more details about the situation. I said ok, but whats the point when they are going to say the same thing. I did ask if the supervisor was able to over ride the decision and she said maybe, but that was almost 2wks ago. More sad than ever, cause they strung me along for 9months.
