Our readers reportedly received payments from a $650 million settlement that resolved a class action lawsuit claiming that Facebook violated Illinois users’ privacy laws.

Payments are in the mail for Facebook users in Illinois who created and stored a face template since June 7, 2011, and submitted a valid claim.

According to the class action lawsuit, Facebook failed to comply with Illinois’ Biometric Information Privacy Act (BIPA) when collecting and storing users’ facial geometry scans. BIPA requires businesses to follow strict guidelines for storage, disclosures and consent agreements.

Facebook agreed to resolve the BIPA class action lawsuit with a $650 million settlement. Initial estimates projected each claimant to receive between $200 and $600, though high participation rates resulted in lower payments. Top Class Actions readers report receiving $7.20 from the BIPA settlement.

To receive a settlement payment, consumers had to submit a valid claim form by Nov. 23, 2020.

The Facebook BIPA class action lawsuit is In re: Facebook Biometric Information Privacy Litigation, Case No. 3:15-cv-03747-JD, in the U.S. District Court for the Northern District of California.

Vimeo, Magisto BIPA settlement payments

Checks are en route to consumers who filed a claim with a $2.25 million settlement that resolved claims Vimeo violated BIPA with its Magisto app.

The settlement benefits any Illinois resident who appeared in a photo or video on the Magisto app and whose face was detected in the photo or video between Sept. 20, 2014, and Jan. 20, 2023.

Plaintiffs in the class action lawsuit accused Vimeo of violating BIPA by collecting facial geometry scans from videos and photos uploaded on its Magisto app. Vimeo allegedly failed to get consumer consent before collecting these biometric profiles.

Vimeo agreed to pay $2.25 million to resolve the BIPA class action lawsuit. Each claimant could receive an equal share of the net settlement fund. Our readers reportedly received electronic payments of $147.46 from this settlement.

In order to receive a settlement payment, consumers had to submit a valid claim form by June 5, 2023.

The Vimeo and Magisto BIPA class action lawsuit is Acaley, et al. v. Vimeo Inc., Case No. 2019CH10873, in the Circuit Court of Cook County, Illinois.

Sound Generations data breach class action rebates

Top Class Actions readers reportedly received payments from a class action lawsuit settlement with Sound Generations.

The settlement benefits individuals whose personal information was compromised or potentially compromised by the Sound Generations data breach reported in December 2021.

According to the class action lawsuit, the Sound Generations cyberattack compromised sensitive consumer information. Plaintiffs argue that Sound Generations could have prevented the data breach by implementing reasonable cybersecurity measures.

Sound Generations agreed to pay an undisclosed sum to resolve the class action. The settlement allowed claimants to receive up to $130 for economic damages or an alternate $25 payment. Top Class Actions readers report receiving payments of $25 from the data breach settlement.

To receive settlement benefits, consumers had to file a valid claim form by July 11, 2023.

The Sound Generations data breach class action lawsuit is Easter, et al. v. Sound Generations, Case No. 21-2-16953-4 SEA, in the Washington Superior Court for King County.

Udemy false advertising settlement payments

Our readers have reported receiving payments from a false advertising settlement resolving claims that Udemy deceptively advertised discounts for its education courses.

The settlement benefits consumers who purchased education courses from Udemy between Aug. 23, 2017, and April 21, 2023.

Plaintiffs in the class action lawsuit claim Udemy advertised its online educational courses at discounted prices but failed to honor these advertisements. As a result, consumers allegedly paid a higher price than expected for their courses.

Udemy didn’t admit any wrongdoing but agreed to pay an undisclosed sum to resolve the false advertising class action lawsuit. Claimants could receive up to $4 for each course they purchased. Top Class Actions’ readers reportedly received payments of up to $20 from this settlement.

In order to receive a settlement payment, consumers had to submit a valid claim form by July 21, 2023.

The Udemy false advertising class action lawsuit is Williams v. Udemy Inc., Case No. 37-2023-00003666-CU-BT-NC, in the California Superior Court for San Diego County.

Medical Review Institute of America data breach class action rebates

Consumers have begun to receive payments from a $2.6 million settlement resolving allegations that the Medical Review Institute of America failed to prevent a 2021 data breach.

The settlement benefits individuals who received a data breach notice from Medical Review Institute of America (MRIA) informing them about a data breach that MRIA learned about on Nov. 9, 2021.

According to the class action lawsuit, MRIA failed to take reasonable cybersecurity measures to protect consumer information from a 2021 data breach. The class action lawsuit accused MRIA of negligence and other wrongdoings.

MRIA agreed to pay $2.6 million to resolve the class action lawsuit. Claimants could receive up to $700 from the settlement for data breach-related losses. Top Class Actions readers have reportedly started to receive payments of $60 from the settlement.

To receive settlement benefits, consumers had to file a valid claim form by July 20, 2023.

The MRIA data breach class action lawsuit is In re: Medical Review Institute of America LLC Data Breach Litigation, Case No. 2:22-cv-00082-DAK-DAO, in the U.S. District Court for the District of Utah.

Bank of America NSF, overdraft fees settlement checks in the mail

Top Class Actions readers reportedly started to receive payments from an $8 million settlement with Bank of America that resolved claims that the bank charged unfair overdraft and NSF fees.

The settlement benefits Bank of America customers who were not refunded for NSF and/or overdraft fees that were charged in connection with a reprocessed check or ACH transaction.

According to the class action lawsuit, Bank of America charged multiple NSF and overdraft fees on check and ACH transactions. Plaintiffs in the case argue that these fees violated the bank’s own fee policies.

Bank of America agreed to pay $8 million to resolve the class action lawsuit. Under the terms of the settlement, each consumer could receive a proportional share of the net settlement fund. Our readers report receiving payments of $6.47 from the settlement.

No claim form was required to benefit from the settlement.

The Bank of America fees class action lawsuit is Checchia, et al. v. Bank of America NA, Case No. 2:21-cv-03585, in the U.S. District Court for the Eastern District of Pennsylvania.
