Portland, Oregon, Safeway surcharge settlement payments

Top Class Actions readers report receiving payments from an $8.75 million settlement resolving claims that Safeway charged illegal surcharges on non-grocery items at its Portland, Oregon, locations.

The settlement accepted claims from consumers who purchased certain non-grocery items at a Safeway store in Portland and were charged a surcharge. 

Plaintiffs in the class action lawsuit claimed Safeway violated local laws by charging an unlawful clean energy surcharge on non-grocery purchases. The city enacted the surcharge in 2019 and ordered retailers of a certain size to pay a 1% surcharge on their revenue.

Safeway hasn’t admitted wrongdoing but agreed to pay $8.75 million to resolve the class action lawsuit. Under the terms of the settlement, Safeway shoppers could receive a maximum of $200. Our readers reportedly received payments of $200 from this surcharge settlement.

In order to receive settlement payments, consumers had to submit a valid claim form by July 1, 2023.

The Portland Safeway surcharge class action lawsuit is Long, et al. v. Safeway Inc., Case No. 19CV45421, in the Oregon Circuit Court for Multnomah County.

Wipe Out! false advertising class action rebates

Top Class Actions readers have started to receive checks from a false advertising class action lawsuit settlement that resolved claims that Wipe Out! wipes were not approved by the Environmental Protection Agency.

The settlement benefits consumers who purchased Wipe Out! Wipes, Wipe Out! Multi-Surface Wipes or Wipe Out! Multi-Surface Decontaminant Spray in the United States on or before April 19, 2023.

According to the false advertising class action lawsuit, Tzumi Innovations deceived consumers into thinking that its wipes had been approved by the EPA and found to be safe. In reality, these wipes were not even submitted to the EPA for registration, the plaintiffs allege.

Tzumi hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the claims. Under the terms of the settlement, claimants could receive up to $15 with proof of purchase or up to $6 without proof of purchase. Top Class Actions readers reportedly received checks and electronic payments of $4.43 from this settlement.

The deadline to submit a claim with the settlement was July 18, 2023.

Wesson Oil false advertising settlement payments

Top Class Actions readers have reportedly begun to receive payments from a $3 million false advertising class action settlement with Wesson.

The settlement provided payments to consumers who purchased Wesson oil products in certain states between Jan. 12, 2006, and July 1, 2017.

According to the plaintiffs, ConAgra Foods misrepresented its Wesson Oil products as “natural” despite containing genetically modified ingredients (GMOs). Consumers say they wouldn’t have purchased the oils or paid as much if they had known they weren’t actually natural.

ConAgra agreed to pay $3 million to resolve the false advertising class action lawsuit. Claimants could receive cash payments based on the number of products they purchased. Our readers received payments of up to $20.80 from this false advertising settlement.

In order to receive a settlement payment, Wesson customers had to submit a valid claim form by May 22, 2023.

The Wesson Oil false advertising class action lawsuit is In re: ConAgra Foods Inc., Case No. CV 11-05379-CJC (AGRx), MDL No. 2291, in the U.S. District Court for the Central District of California.

Restasis antitrust class action rebates

Top Class Actions readers also have started to receive payments from a $30 million class action lawsuit settlement with Allergan resolving claims that it conspired to raise the price of Restasis eye drops.

The settlement benefits consumers who purchased or paid for Restasis eye drops in certain states between May 1, 2015, and July 21, 2021.

Allergan allegedly conspired with other pharmaceutical companies to raise and fix the price of Restasis eye drops and its generic alternatives. This scheme caused consumers and other payors to overpay for the eye drops, the class action lawsuit contends.

Allergan agreed to pay $30 million to resolve the antitrust class action lawsuit. Under the terms of the settlement, consumers could receive a cash payment based on the number of units and price they paid for Restasis. Top Class Actions readers received payments of up to $301.29 from this antitrust class action lawsuit settlement.

The deadline to submit a claim with the settlement was Aug. 11, 2022.

The Restasis antitrust class action lawsuit is In re: Restasis (Cyclosporine Ophthalmic Emulsion) Antitrust Litigation, Case No. 18-md-2819 in the U.S. District Court for the Eastern District of New York.

Vizzy false advertising settlement payments

Top Class Actions readers have received checks from a $9.5 million class action lawsuit settlement resolving claims that Vizzy hard seltzer is falsely advertised as containing a “superfruit.”

The settlement benefits consumers who purchased any Vizzy hard seltzer beverage in the United States between Jan. 1, 2020, and March 10, 2023.

According to the false advertising class action lawsuit, Molson Coors falsely advertised Vizzy seltzers as containing “antioxidant vitamin C from acerola superfruit.” In reality, the drinks allegedly contain an “insignificant amount” of vitamin C that was misleadingly represented as sourced from superfruits.

Molson Coors agreed to pay $9.5 million to resolve the false advertising class action lawsuit. Under the terms of the settlement, claimants could receive up to $15 without proof of purchase. Our readers reportedly received electronic payments of $11.63 from this settlement.

In order to receive a settlement payment, consumers had to submit a valid claim form by June 6, 2023.

USA LLC, Case No. 22-cv-60889, in the U.S. District Court for the Southern District of Florida.

Artnaturals hand sanitizer benzene class action rebates

Consumers have reportedly begun to receive payments from a $3.1 million class action lawsuit settlement claiming that Artnaturals hand sanitizer was contaminated with benzene.

The settlement benefits consumers who purchased any hand sanitizer product from Artnaturals between Jan. 1, 2015, and May 23, 2023.

Plaintiffs in the class action lawsuit claim Artnaturals sold hand sanitizer that was contaminated with benzene, a known human carcinogen. According to the class action lawsuit, consumers unknowingly put themselves at risk for serious harm by purchasing the products.

Artnaturals agreed to pay $3.08 million to resolve the benzene class action lawsuit. The settlement allowed claimants to receive a cash payment based on the number and cost of the products they purchased. Top Class Actions readers report receiving electronic payments of up to $16.53 from this settlement.

The deadline to file a claim with the settlement was Aug. 12, 2023.

The Artnaturals benzene class action lawsuit is Brodowicz, et al. v. Virgin Scent Inc. d/b/a ArtNaturals Inc., et al., Case No. 0:21-cv-60643-RKA, in the U.S. District Court for the Southern District of Florida.
