Payments from several class action settlements are on the way to consumers who experienced false advertising, data breaches, privacy violations and other consumer law concerns.
Dickey’s Barbecue data breach settlement payments
Top Class Actions readers report receiving payments from a $2.35 million class action lawsuit settlement that resolved claims that Dickey’s Barbecue Restaurant failed to adequately protect consumer information from a 2019 and 2020 data breach.
The settlement benefits consumers who used a payment card to make a purchase at a Dickey’s Barbecue Pit restaurant between April 23, 2019, and Oct. 29, 2020.
According to the class action lawsuit, Dickey’s failed to protect consumer information from a data breach that lasted more than a year between 2019 and 2020. This extended data breach allegedly allowed hackers to steal customer payment information and sell it on the dark web.
Dickey’s agreed to a $2.35 million settlement to resolve the class action lawsuit. Under the terms of the settlement, consumers could receive up to $5,000 for documented data breach expenses or a flat-rate payment of up to $150. Top Class Actions readers reportedly received payments of up to $13.97 from this settlement.
The deadline to submit a claim in the class action lawsuit settlement was April 22, 2024.

Curaleaf THC false ad class action rebates
Top Class Actions viewers reportedly received settlement payments from a $100,000 Cureleaf settlement resolving claims the dispensary’s CBD drops contained psychoactive THC despite claiming to contain only CBD.
The settlement benefits Oregon consumers who purchased mislabeled Curaleaf Select CBD Drops after June 19, 2021.
The class action lawsuit claims Curaleaf failed to properly label its Select CBD Drops as containing both THC and CBD. According to consumers, they wouldn’t have purchased the products if they knew they contained psychoactive THC in addition to CBD.
Curaleaf agreed to a $100,000 settlement to resolve the false advertising class action lawsuit. Under the settlement terms, claimants could receive up to $200. Top Class Actions readers report receiving electronic payments of $200 from the false advertising class action settlement.
The deadline to submit a claim in this settlement was Sept. 27, 2023.
The Curaleaf THC false advertising class action lawsuit is Williamson v. Curaleaf Inc., Case No. 3:22-cv-00782-IM, in the U.S. District Court for the District of Oregon.
Bank of America overdraft fees settlement checks
Top Class Actions readers reportedly received a second payment from a $66.6 million overdraft fee class action lawsuit settlement with Bank of America.
The settlement benefits current and former Bank of America customers who incurred at least one $35 extended overdrawn balance charge in connection with their Bank of America personal checking account.
According to the class action lawsuit, Bank of America violated its own account terms by charging “extended” overdraft fees in addition to initial overdraft fees. Plaintiffs in the case argue they were financially injured by this overdraft policy.
Bank of America agreed to pay $66.6 million to resolve the overdraft class action lawsuit. Under the settlement terms, consumers could automatically receive a payment based on the charges they paid. After previously receiving an initial payment from the settlement, Top Class Actions readers received a second distribution of $32.64 from this settlement.
No claim form was required to receive payments from the overdraft fee settlement.
The Bank of America overdraft class action lawsuit is Joanne Farrell, et al. v. Bank of America NA, Case No. 3:16-cv-00492-L-WVG, in the U.S. District Court for the Southern District of California.
DoubleDown casino games class action rebates
Top Class Actions viewers reportedly received a second round of settlement payments from a $415 million agreement with DoubleDown Interactive, a casino game company.
The settlement benefits consumers who played DoubleDown Casino, DoubleDown Fort Knox, DoubleDown Classic and/or Ellen’s Road to Riches before Nov. 14, 2022.
Plaintiffs in the class action lawsuit claim DoubleDown’s casino games used in-game currency that could be purchased with real money. Users claim they are forced to purchase currency to play the games, qualifying the apps as real gambling services in violation of Washington’s laws.
DoubleDown agreed to pay $415 million to resolve the gambling class action lawsuit. Consumers could receive a cash payment based on the amount they spent on in-game purchases. After money was left in the fund following initial settlement payments, Top Class Actions readers report receiving large payments of up to $5,978.66 from a second distribution.
The deadline to file a claim with this settlement was April 11, 2023.
The DoubleDown casino games class action lawsuit is Benson, et al. v. DoubleDown Interactive LLC, et al., Case No. 2:18-CV-00525 in the U.S. District Court for the Western District of Washington.
Respondus BIPA settlement checks
Top Class Actions readers report receiving payments from a $6.25 million BIPA settlement with Respondus resolving claims it collected biometrics of exam takers without complying with state laws.
The settlement benefits individuals who took an exam using Respondus Monitor while physically present in Illinois at any time between Nov. 11, 2015, and June 2, 2023.
According to the class action lawsuit, Respondus violated Illinois’ Biometric Information Privacy Act (BIPA) by collecting student biometrics without their express consent. BIPA required businesses to obtain consent and provide certain notices before collecting biometrics, such as facial geometry scans.
Respondus Inc. agreed to pay $6.25 million to resolve the BIPA class action lawsuit. Claimants could receive an equal share of the net settlement fund. Top Class Actions readers reportedly received settlement payments of up to $2,659.81.
The deadline to submit a claim in the BIPA settlement was August. 30, 2023.
The Respondus BIPA class action lawsuit is Veiga, et al. v. Respondus Inc., Case No. 2023LA000430, in the U.S. Circuit Court for the 18th Judicial Circuit for the State of Illinois, County of DuPage.
Right Guard benzene contamination class action rebates
Top Class Actions viewers reportedly received payments from a $1.9 million class action lawsuit settlement resolving claims that Right Guard spray deodorant was contaminated with benzene.
The settlement benefits consumers who purchased Right Guard Sport and Right Guard Xtreme antiperspirant aerosol and spray products between Nov. 19, 2018, and June 8, 2023.
Plaintiffs in the class action lawsuit claim Right Guard deodorant was contaminated with benzene, a known human carcinogen. Benzene has been linked to leukemia and other serious health problems.
Right Guard manufacturers agreed to pay $1.9 million to resolve the benzene contamination class action lawsuit. Under the terms of the settlement, consumers could receive up to $1.75 per purchased product. Top Class Actions readers report receiving payments of $3.24 from the benzene contamination class action lawsuit settlement.
The deadline to submit a claim with this settlement was Oct. 14, 2023.
The Right Guard benzene contamination class action lawsuit is Goldstein v. Henkel Corp., et al., Case No. 3:22-cv-00164 (AWT) in the U.S. District Court for the District of Connecticut.
