Kimpton Hotels Data Breach Settlement Checks

One claimant in the Kimpton Hotels data breach class action lawsuit reported receiving a settlement check for $10,125.

The $600,000 settlement resolved claims that the hotel company failed to protect its customers from a data breach.

Class Members include anyone whose payment card information was compromised during the 2016 breach.

Kimpton announced the breach in 2016.

Attackers installed malware onto Kimpton servers, compromising the payment data.

Nearly 150,000 consumers who had used credit or debit cards at a Kimpton hotel or restaurant were at risk for potential unauthorized charges and identity theft.

The deadline to file a claim for the Kimpton Hotels class action settlement passed on Aug. 22, 2019.

The Kimpton Hotels Data Breach Class Action Lawsuit was Parsons v. Kimpton Hotel & Restaurant Group LLC, Case No. 3:16-cv-05387-VC, in the U.S. District Court for the Northern District of California.

Vivint Solar TCPA Settlement Checks

Settlement checks worth $8.35 have reached Class Members in the Vivint Solar TCPA class action lawsuit.

The settlement benefited consumers who received a call or multiple calls advertising Vivint Solar energy between July 1, 2014, and Nov. 8, 2019.

Vivint Solar agreed in December to pay $975,000 to resolve claims that the company violated federal law through its use of unsolicited robocalls.

Some consumers reported receiving calls from a company identifying itself as “Smart Home Solar.” Those calls were then followed by communication from Vivint Solar.

The class action lawsuit was filed in July 2018 by plaintiff Darrell Rogers, who alleged the company used an automatic telephone dialing system along with an artificial or prerecorded voice to place the calls. 

settlement money falling into handsThe plaintiff argued the company was violating the Telephone Consumer Protection Act (TCPA), a federal law protecting consumers from harassing telemarketing calls, text messages and faxes.

The deadline to file a claim for the Vivint Solar settlement passed on Feb. 21,2020.

The Vivint Solar TCPA Class Action Lawsuit was Darrell Rogers, et al. v. Vivint Solar Inc., et al., Case No. 1:18-cv-01567, in the U.S. District Court for the District of Columbia.

Evanger’s Toxic Pet Food Settlement Checks

Consumers have been receiving class action rebates and, alternatively, cans of dog food in the Evanger’s toxic pet food class action settlement.

Claims made with no proof were sent three cans of dog food as a result of the settlement.

However, checks are being mailed to other consumers: One reader reported receiving a check for $868.21.

The pet food company agreed to pay $545,500 to settle claims that the food contained poisonous ingredients.

The settlement enabled consumers who bought Evanger’s Hunk of Beef, Evanger’s Braised Beef or Against the Grain Pulled Beef with Gravy between Dec. 1, 2015 and June 30, 2017, to receive compensation.

The class action lawsuit was filed in June 2017 after plaintiffs Nicole and Guy Mael fed their dogs Hunk of Beef and Pulled Beef dog food in 2016 and saw the animals quickly become ill with neurological symptoms.

They rushed their pets to the vet, but one of the dogs reportedly died the following day. The others recovered but require ongoing care, such as anti-seizure medicine.

The Maels alleged that the Evanger’s dog food contained pentobarbital, which is used for purposes such as euthanizing animals, executing humans and conducting physician-assisted suicide.

The deadline to file a claim for this settlement passed on March 9, 2020.

The Evanger’s Toxic Pet Food Class Action Lawsuit was Nicole and Guy Mael, et al. v. Evanger’s Dog and Cat Food Inc., et al., Case No. 3:17-cv-05469, in the U.S. District Court for the Western District of Washington.

Essex Gas Station Price Fixing Settlement Checks

Essex gas station customers have reportedly been receiving settlement checks worth as much as $21.55.

Essex gas stations agreed to pay $1.5 million to resolve claims of price fixing between 2012 and 2015 at several gas stations in Vermont.

Those eligible to receive the class action rebates are individuals and businesses who owned a validly registered motorcycle, three-wheel vehicle, car truck or van, lived in Chittenden, Franklin or Grand Isle counties, and purchased fuel from certain gas stations between the applicable dates.

Plaintiffs in the Essex gas station price fixing class action lawsuit accused R.L. Vallee Inc., S.B. Collins Inc., Wesco Inc. and Champlain Oil Company Inc. of conspiring to artificially fix fuel prices in the area. 

The deadline to file a claim passed on March 26, 2020.

The Essex Gas Station Price Fixing Class Action Lawsuit was Kent, et al. v. R.L. Vallee Inc., et al., Case No. 617-6-15-CNCV, in the Vermont Superior Court for the Civil Division of Chittenden Unit.

    Evangers we had seven dogs that ate that food and become violently one almost died luckily we were able to save her I called evangers I found a complaint I even called the pet store where it was purchased and to let them know nothing they would not take it off the shelves or anything and we gave evangers all the information and I filed suit under this class action and I have never received a check of any kind

    I read that checks were mail for grove coffee, however I did not get my money back! Is there something else I need to do to get my money back? Or why didn’t I get a check?
