Top Class Actions viewers are receiving long-awaited checks in the mail from the Carnival Cruise, Royal Caribbean telemarketing class action settlement worth as much as $25.02!

The class action settlement resolves claims that Resort Marketing Group placed robocalls promoting travel on Carnival, Norwegian, and Royal Caribbean cruise lines to consumers who had not given express written consent to receive such calls.

Plaintiff Philip Charvat filed the Carnival Cruise class action lawsuit back in 2012 over allegations that the cruise lines were using an auto-dialer system that operated five days a week from 9 a.m. to 9 p.m. The plaintiff claimed the marketing calls violated the Telephone Consumer Protection Act.

A settlement was reached in 2017 that was worth up to $12.5 million and was expected to payout Class Members $300 per robocall, up to three calls. The amount was subject to a pro rata basis depending on the number of claims filed for the Carnival Cruise class action settlement.

Although it was preliminarily approved in July 2017, the Carnival Cruise class action settlement went through a series of delays due to follow-up proof and objections.

In 2018, the settlement administrator sent out emails to about 2 million claimants, seeking supplementary proof in relation to their claims.

The Carnival Cruise, Royal Caribbean telemarketing class action settlement was granted final approval in October 2019, but appeals were filed within the 30 day deadline.

Amendments were made to the initial settlement that would allow for a second distribution of checks if Class Members would be able to receive a minimum of $2.50.

U.S. District Judge Andrea R. Wood granted approval of the new settlement in February 2020.

In the end, 275,000 Class Members were expected to receive a class action rebates check of an average of $22. The lowest check totaled $8 and the highest check issued was reportedly $598, according to the judge’s order.

Class Members in the Carnival Cruise class action settlement include consumers nationwide who received at least one telemarketing call offering a free cruise from Carnival, Royal Caribbean and Norwegian cruise line between July 2009 and March 2014.

The deadline to file a claim for the Carnival Cruise telemarketing class action settlement passed on Nov. 3, 2017.
