Florida abortion ban overview:

Florida Gov. Ron DeSantis has signed a bill that will put in place an abortion ban in the state after six weeks. The bill equates the timeline of six weeks to when the fetus will have a heartbeat inside the mother.

Senate Bill 300 has been dubbed the Heartbeat Protection Act. The Florida House of Representatives passed the bill Thursday. 

The law prevents a physician from performing or inducing an abortion after six weeks. The state’s previous abortion ban was at 15 weeks. The law has exceptions for rape, incest or human trafficking before 15 weeks.

“We are proud to support life and family in the state of Florida,” DeSantis said in a statement about the Florida abortion ban. “I applaud the Legislature for passing the Heartbeat Protection Act that expands pro-life protections and provides additional resources for young mothers and families.”

The Florida abortion ban law states medications used to give an abortion must be given in person and not via telehealth or mailed to the patient.

Most won’t know they are pregnant until after six weeks, according to ACLU 

The American Civil Liberties Union (ACLU) said six weeks is before most women know they are pregnant. 

“Just to be very clear: many people will not even know they are pregnant by six weeks, and for those who do, it is unlikely they will be able to obtain the two state-mandated OBGYN appointments within that strict time frame,” ACLU of Florida Legislative Director Kara Gross said in a news release about the Florida abortion ban. “The bill’s exceptions are so onerous and impracticable that they are virtually meaningless.

“This near-total abortion ban will effectively eliminate legal abortion care in Florida. It will force hundreds of thousands of pregnant people to have to travel out of state to seek the care they need.”

Several similar heartbeat abortion bills in other states have already been challenged in court. A Wyoming judge recently blocked a statewide abortion ban, while Oklahoma’s Supreme Court ruled its state constitution protected abortions in life-threatening situations.
