Jaguar Land Rover windshield defect class action lawsuit overview: 

  • Who: Jason Rains and David Cerutti filed a class action lawsuit against Jaguar Land Rover North America, LLC. 
  • Why: Rains and Cerutti claim Jaguar Land Rover knowingly sells model year 2020-2022 Land Rover Defender vehicles containing defective windshields prone to chipping and fracturing. 
  • Where: The class action lawsuit was filed in New Jersey federal court. 

Jaguar Land Rover North America knowingly sells Land Rover Defender vehicles containing defective windshields that are prone to chipping and fracturing, a new class action lawsuit alleges. 

Plaintiffs Jason Rains and David Cerutti claim Jaguar Land Rover has known since as early as 2019 that its model year 2020-2022 Land Rover Defender vehicles were built with allegedly defective windshields. 

The alleged windshield defect is caused by either a deficiency in the structure of the Land Rover Defender vehicles or because deficient materials were used to make the windshields, the Jaguar Land Rover class action alleges. 

Rains and Cerutti want to represent a nationwide class and New Jersey and Utah subclasses of all persons or entities who have purchased or leased a 2020-2022 Land Rover Defender vehicle. 

The windshields on the 2020-2022 Land Rover Defender vehicles fail for “no reason at all” and often “immediately after class members take ownership of the vehicles,” according to the Jaguar Land Rover class action. 

Jaguar Land Rover class action alleges company refuses to repair windshields

Rains and Cerutti claim that Jaguar Land Rover refuses to repair or replace the allegedly defective windshields even in the event that they break “nearly immediately” after they are sold. 

Further, Rains and Cerutti argue the allegedly defective windshields can distract a driver and impair their view, presenting an “extreme safety hazard to drivers, passengers and pedestrians.” 

Rains and Cerutti claim Jaguar Land Rover is guilty of fraudulent concealment and unjust enrichment, among other things, and in violation of the Magnuson-Moss Warranty Act and the New Jersey Consumer Fraud Act, among other things. 

They demand a jury trial and request injunctive and declaratory relief along with actual, incidental, consequential and punitive damages for themselves and all class members. 

In January, a class action settlement involving Jaguar Land Rover opened for consumers to make claims if they owned or leased certain Land Rover vehicles containing defective timing chains.

    SALVD5RX0KH345324 I purchased Range Rover Evoque used from Range Rover dealer in New York state. It is currently in shop with excessive water damage on interior from leaks in windshield. I bought this on 12/12/2022. I understand their is a lawsuit involving this and I believe the dealer should have informed me

    I have a 2019 Land Rover Discovery and while driving home tonight in the rain, water was seeping in some how through the top of windshield and soaking the headliner too. I am worried it is going to cause electrical damage.

    Unexplained crack and leaking. Land Rover will NOT replace the window even though they acknowledge that theire was a recall. They are saying that the recall ended this past summer and that they are no longer responsible for it because the window was not leaking before hand.
