Papa John’s is facing a class action lawsuit claiming the company sent repeated marketing text messages to individuals despite their attempts to opt out of the messages.
The Papa John’s text messages are a violation of the Telephone Consumer Protection Act (TCPA), the lawsuit claims.
“Defendant’s text messages constitute telemarketing because they encouraged the future purchase or investment in property, goods, or services, i.e., selling pizza and other food from Papa John’s,” the class action says.
Papa John’s does not keep an internal do-not-call list nor does it train staff on adding people who opt out to a do-not-call list, the lawsuit from plaintiff Barry Lourie claims.
Plaintiffs seek up to $1,500 per text message after opt-out
The plaintiffs are asking for up to $1,500 in damages per text message after an opt out and believe the overall class deserves more than $5 million in damages total for the class.
They are also asking for an injunction against Papa John’s for the text messages along with damages and attorney’s fees for those whose requests to opt out of the marketing messages were not honored by Papa John’s.
The class asked the court to require Papa John’s to “preserve all records, lists, electronic databases or other itemizations associated with the allegations herein, including all records, lists, electronic databases or other itemizations in the possession of any vendors, individuals, and/or companies contracted, hired, or directed by defendant to assist in sending the alleged communications.”
The company was one of several hit with class action lawsuits in the past year alleging they used session-replay software to covertly intercept and record the electronic communications of visitors to their website in real time.

I not only received unsolicited messages I received them AFTER they banned me fir saring yo complain about my order being wrong. Again and again and again for two solid years they never got one single order correct. And i wasn’t requesting compensation it was a matter of me asking for cheese instead if garlic dip, whichninoaid a premium for and still wouldn’t receive cheese sauce, not ever. So yes indeed count me in
