Telemarketers work in a phone bank.You may be one of the many people that are bothered on a daily basis by spam calls. And you may have tried a variety of ways to curb the onslaught of telemarketers. Unfortunately, many people find that their best efforts to prevent spam calls are ineffective.

The healthcare insurance industry may be behind many of these spam calls, to include marketing efforts by both legitimate insurance companies as well as scammers attempting to gain access to consumers’ personal information. These calls may come from people claiming to have updates on your policy, among other reasons. It’s not uncommon for individuals faced with persistent telemarketing calls to feel helpless when trying to stop health insurance calls. 

Are Health Insurance Spam Calls Legal?

Unfortunately, some irritating calls from health insurance companies may be legal. If you signed a form consenting for your health insurance provider to call you, the solicitations you are getting may be allowed by law. 

During business transactions, any business may request permission to contact you in the future. Some customers may accidentally sign a form giving consent to receive phone calls without realizing that they have done so. Some companies may intentionally make these consent forms hard to spot, so they can maximize the number of people they can call.

However, not all spam calls from insurance companies are legal. The Telephone Consumer Protection Act (TCPA) prohibits businesses from directing telemarketing calls, texts, and voice mails to individuals who have not given prior, express consent to be contacted. Unfortunately, many businesses may try to dodge the law’s requirements, or may violate the TCPA’s requirements altogether.

The TCPA also prohibits businesses from sending spam calls, texts, and voicemails to individuals who have registered their number on the National Do Not Call Registry. Unfortunately, even this may not be entirely effective.

How Can I Stop Health Insurance Calls?

Many consumers have tried blocking numbers, registering their numbers on the National Do Not Call Registry, and screening calls entirely. However, if you have taken these steps and you are still getting persistent calls from a company, you may want to file a TCPA lawsuit to stop health insurance calls.

A lawyer may help you get between $500 and $1,500 in statutory damages per spam call that you receive from a specific company, because the TPCA allows individuals to seek $500 for each negligent violation of the law, and $1,500 for each willful violation of the law. 

Consumers have successfully filed TCPA spam call lawsuits against businesses in many industries. A couple from Florida won over $1 million from Bank of America after they filed a TCPA lawsuit claiming they were wrongly subjected to hundreds of debt collection calls over a period of years, according to ABC News.

Florida-based Caribbean Cruise Line, among others, settled a TCPA lawsuit with customers claiming the company wrongly contacted them. In 2017 NBC News reported that more than a million customers were eligible for money from the settlement.
