Carvana text messages class action overview: 

  • Who: Carvana is facing a class action lawsuit related to text messages it is accused of sending.

Carvana is facing a class action lawsuit claiming that the company repeatedly sent unsolicited marketing text messages to people who asked not to receive them.

The customers are on the National Do Not Call Registry and asked to be on an internal do-not-call list, making the messages a violation of the Telephone Consumer Protection Act (TCPA).

Lead plaintiff Michael Cribier provided repeated messages he received calling him “Ian” and asking him to upload information related to a trade-in vehicle and a vehicle purchase. Despite repeatedly texting “stop” to the Carvana text messages, the company continued to contact him, Cribier alleges.

“Defendant continuously and willingly ignored plaintiff’s requests for defendant to stop sending him text messages,” the Carvana class action says. “… Plaintiff received at least two telephone solicitations from defendant within a 12-month period. Plaintiff did not provide defendant with his cellular telephone number at any point in time, nor did he give permission for defendant to message it.”

Plaintiff requests $500 per TCPA violation, and $1,500 per ‘knowing and willful’ violation

The class action proposes two classes related to the National Do Not Call Registry and Carvana’s internal do-not-call list.

The plaintiff is asking for $500 per violation of TCPA, as well as $1,500 for each knowing and willful violation for each class, plus attorneys’ fees.

“Defendant knew that it did not have prior express written consent to send these text messages and/or phone calls, and knew or should have known that it was sending text messages or phone calls to cellular numbers placed on their Internal Do-Not-Call List in violation of the TCPA,” the Carvana class action says.

Carvana is facing a class action lawsuit claiming it fails to register the vehicles it sells to consumers in a timely manner, stopping purchasers from getting legally required auto insurance.

    I was able to stop the text messages when I replied STOP but now I have been getting calls almost daily for at least 3 months. I have never been a customer or given them any of my information. My phone is on n Do Not call List. I blocked the number but still have to delete the annoying voice mails every day. I hope someone makes enough Off this lawsuit to put them out of business for good
