Visionworks unsolicited marketing messages class action lawsuit overview: 

  • Who: Anthony Lawson filed a class action lawsuit against Visionworks of America Inc. 
  • Why: Lawson claims Visionworks violated the Telephone Consumer Protection Act by sending unsolicited marketing messages to consumers, including those which have their numbers listed on the National Do Not Call Registry
  • Where: The class action lawsuit was filed in Florida federal court. 

Visionworks has harmed thousands of consumers with unsolicited marketing messages, including ones sent to numbers listed on the National Do Not Call Registry, a new class action lawsuit alleges. 

Plaintiff Anthony Lawson claims the marketing messages sent by Visionworks are an “invasion of privacy, harassment and aggravation” and disrupted the daily lives of thousands of consumers like himself. 

Lawson argues that Visionworks violates the Telephone Consumer Protection Act (TCPA) by allegedly sending the unsolicited marketing messages, including to numbers on the National Do Not Call Registry. 

“The TCPA forbids companies from placing calls to consumers who have placed their phone numbers on the national Do-Not-Call Registry,” the Visionworks class action states.

Lawson claims he was “inundated” with marketing messages from Visionworks in 2020, which he argues continued even after he made multiple attempts to opt out of receiving them. 

“Nevertheless, Defendant simply ignored those requests,” the Visionworks class action states. 

The company’s marketing messages, meanwhile, “constitute as telemarketing”  — and thus violate the TCPA — since they “encouraged the future purchase or investment in property, goods or services,” the class action alleges. 

Lawson demands a jury trial and requests declaratory and injunctive relief along with an award of statutory damages for himself and all class members. 

He wants to represent a nationwide class of consumers who received an unsolicited marketing message from Visionworks despite having their number on the National Do Not Call Registry, as well as individuals who kept receiving messages more than three days after making an opt-out request. 

A separate class action lawsuit was filed against Visionworks earlier this year over claims the company failed to design its website in a way that would make it fully accessible for individuals who are blind or visually impaired.
