Hallmark text messages class action lawsuit overview:

Hallmark Cards repeatedly sent telemarketing text messages to consumers, including those with numbers on the National Do-Not-Call Registry, despite being asked by them to stop, a new class action lawsuit alleges.
Plaintiff James Williams claims Hallmark invaded his privacy by continuing to send him telemarketing text messages after he “repeatedly” attempted to opt out of receiving them.
Williams received the telemarketing text messages from Hallmark despite registering his phone number on the National Do-Not-Call Registry in June 2022, the class action lawsuit states.
“Plaintiff has repeatedly asked Hallmark to ‘Stop’ messaging him; however, Hallmark ignored the requests and proceeded to place repeated additional telemarketing text messages to Plaintiff,” the class action claims.
Hallmark class action claims retailer sent text messages to consumers without consent
Hallmark sent telemarketing text messages to Williams despite him having “no prior business relationship” with the company and without him ever giving Hallmark consent to contact him, the Hallmark class action alleges.
Williams claims Hallmark “deliberately programmed” its telephone dialing systems to ignore opt-out requests despite it allegedly having the ability to honor them.
“In addition to using Plaintiff’s telephone data, phone storage and battery life, Plaintiff’s privacy was wrongfully invaded,” the class action states.
Williams claims Hallmark violates the Telephone Consumer Protection Act (TCPA). He demands a jury trial and requests injunctive relief along with an award of statutory and treble damages for himself and all class members.
Williams wants to represent a nationwide class of consumers whom Hallmark sent texts to more than once and after being asked to stop within a year despite having a number listed on the National Do-Not-Call Registry for at least 30 days
In other Hallmark news, in August, Hallmark issued a recall for around 16,700 of its wooden baby teether rings over concerns they could break and pose a choking hazard.
