GameStop user transcripts class action lawsuit overview:

GameStop “covertly wiretaps” the communications of website visitors who use its chat feature and then share the transcripts with a third party, a new class action lawsuit alleges.
Plaintiff Miguel A. Licea claims GameStop makes “secret transcripts” and then shares them with Zendesk, a third party company which allegedly “boasts of its ability to harvest personal data from the transcripts for marketing and other purposes.”
Licea argues GameStop is in violation of the California Invasion of Privacy Act (CIPA) by allegedly creating the transcripts and providing them to a third party without obtaining prior express consent.
“Unlike most companies, Defendant has chosen not to comply with CIPA,” states the GameStop class action. “Rather, without warning visitors or obtaining their consent, Defendant has secretly deployed wiretapping software on its Website.”
Licea wants to represent a California class of consumers who have visited GameStop’s website and had their electronic communications recorded, stored, or shared by the company without their prior express consent.
GameStop accused of conduct both ‘illegal’ and ‘offensive’
Licea argues that GameStop’s alleged conduct is “both illegal and offensive” and that consumers would be “shocked and appalled” to learn that GameStop is allegedly secretly creating transcripts of their chat conversations and sharing them with a third party.
“Given the nature of Defendant’s business, website visitors typically share highly personal and sensitive data with Defendant when using the website chat feature,” states the GameStop class action.
Licea is demanding a jury trial and requesting declaratory and injunctive relief along with an award of statutory and punitive damages for himself and all class members.
A similar class action lawsuit was filed against GameStop last month over claims the company shares the personally identifiable information of its customers with Facebook without their customers’ consent.
