Samsung failed to safeguard the private information of thousands of its customers, resulting in a cyberattack and data breach, a new class action lawsuit alleges.
Plaintiff Shelby Harmer filed the class action lawsuit against Samsung Electronics America, Inc. Sept 6. In a Nevada federal court, alleging violations of privacy and contract laws.
Around Aug. 4,, a group of cybercriminals gained access to certain files on the Samsung computer network and servers containing personal information belonging to customers, the Samsung class action alleges.
“This class action is brought on behalf of Samsung’s customers whose personally identifiable information was stolen by cybercriminals in a cyber-attack that accessed sensitive information through Samsung’s U.S. systems,” the lawsuit states.
After the Samsung data breach, affected customers were not notified that their information had been exposed until Sept. 2, almost one month after their information was first accessed, the class action says.
Samsung class action claims company failed to safeguard customer information
As a result of Samsung’s failure to properly secure customers’ personal information, the cybercriminals obtained “extensive personal information” including names, name, contact and demographic information, date of birth and product registration information, according to the Samsung data breach lawsuit.
Affected customers were then forced to take remedial steps to protect themselves from future harm.
“Indeed, Plaintiff and all of the Class Members are currently at a very high risk of misuse of their Private Information in the coming months and years,” the Samsung class action states.
Harmer sued on behalf of anyone whose sensitive personal information was obtained by cybercriminals during the Aug. 2022 Samsung data breach.
She sues for negligence, invasion of privacy and breach of contract and seeks certification of the class action lawsuit, damages, fees, costs and a jury trial.
The news comes after Samsung was hit with a class action lawsuit in July alleging it is able to cheat speed and performance tests to make its smartphone devices appear faster than they actually are.
