Technology-giant Intel is wiretapping users by tracking keystroke and mouse movements on its site, a class action lawsuit alleges.
The proposed class action lawsuit was moved to Florida federal court late last week, with lead plaintiff Holly Londers alleging at least a dozen of her visits to the Intel site, mostly in January 2021, were tracked and recorded without her consent.
Londers claims Intel intercepted her mouse clicks and movements, along with inputted information and pages viewed, exposing her privacy and private information.
“At no point in time did Plaintiff provide Defendant, its employees, or agents with consent to intercept Plaintiff’s electronic communications,” the lawsuit states.
Although court documentation lists no specific software, an attorney involved in the case reportedly hinted to The Register that the third party company involved is believed to be Clicktale.
According to PC Gamer, data from tracking software Blacklight showed Intel uses “a session recorder, which tracks user mouse movement, clicks, taps, scrolls, or even network activity.”
However, the site didn’t detect any keystroke logging and it is unclear how the session data is being used, PC Gamer explains.
Intel’s privacy statement says the company collects information as part of its business operations, “to provide services, to respond to requests and offer customer support, to fulfill legal and contractual obligations and to build its innovative products.”
It says users provide that data directly and it also collects information through interactions with Intel services and third parties.
PC Gamer notes that while Intel admits it collects information through third parties, it does not specifically say what information is being recorded and stored.
In her class action lawsuit, Londers alleges Intel wiretapped her sessions for its own financial gain.
Londers is looking to represent anyone living in Florida who visited Intel’s website and had their communications intercepted without their consent.
She is asking for $100 a day for each day of the violation or $1000, whichever amount is greater. She is also seeking legal fees, damages, an injunction, and a jury trial.
