A new class action lawsuit claims FragranceNet sent unsolicited text messages to consumers’ phone numbers that were registered on the National Do-Not-Call Registry.
Plaintiff Andrea Velazquez filed the class action complaint against FragranceNet on Aug. 11 in California federal court, alleging violations of the Telephone Consumer Protection Act (TCPA).
According to the FragranceNet class action lawsuit, the company sent unsolicited telemarketing text messages to Velazquez and other consumers, including multiple messages initiated before 8 a.m. or after 9 p.m.
The class action alleges that FragranceNet also transmitted repeated telemarketing text messages to telephone numbers listed on the National Do-Not-Call Registry for at least 30 days.
FragranceNet class action alleges multiple TCPA violations
Velazquez claims she did not provide FragranceNet with prior express invitation or permission to send telemarketing or solicitation text messages to her phone number, which, she says, has been listed on the National Do-Not-Call Registry since January 2016.
The plaintiff says she received multiple text messages from FragranceNet in May 2026 promoting the company’s goods or services. She says the messages did not include instructions for recipients to opt-out.
Velazquez asserts FragranceNet does not have a signed written agreement that would satisfy the Federal Communications Commission’s (FCC) requirements for prior express invitation or permission. She also claims she had no established business relationship with FragranceNet at the time of the messages — all TCPA violations.
The FragranceNet class action lawsuit asserts the company’s conduct violated the TCPA and FCC regulations. Velazquez seeks injunctive relief, statutory damages, treble damages for willful or knowing violations, and costs.
Velazquez proposes to represent a class of all persons who, from four years prior to the filing of the action, received more than one telemarketing text message from FragranceNet within a 12-month period where at least one such message was initiated before 8 a.m. or after 9 p.m.
She also seeks to represent a subclass of consumers who received more than one telemarketing text message within a 12-month period to a phone number that had been listed on the National Do-Not-Call Registry for at least 30 days before the first challenged text message.
In other alleged TCPA violations, a consumer is suing Ruggable for sending her marketing text messages at 6:01 a.m. and 6:02 a.m.
