Tylenol titanium dioxide class action overview:

  • Who: A Tylenol consumer is suing Johnson & Johnson.
  • Why: The plaintiff says Tylenol contains a harmful heavy metal that consumers are not told about.
  • Where: The lawsuit was filed in a California federal court.

Popular pain reliever Tylenol contains the harmful heavy metal titanium dioxide, which consumers are not warned about on the label, a new class action lawsuit alleges.

Plaintiff Valerie Morrison filed the class action lawsuit against Johnson & Johnson Consumer Inc. (J&J) Aug. 29 in a California federal court, alleging violations of state and federal consumer laws.

She says, for decades, J&J has sold Tylenol, which is designed to relieve pain.

Many varieties, however, quietly contain titanium dioxide (TiO2), a substance used to enhance the whiteness of paint, plastics, paper products and certain foods and drugs, Morrison says.

Studies have shown that TiO2 exposure can cause pathological lesions of the liver, spleen, kidneys, and brain, as well as lung tumors; inflammation, cell necrosis, and dysfunction in the kidneys, the lawsuit states.

In light of this, the Center for Food Safety has challenged major corporations to remove TiO2 from their foods, Morrison says.

As a global corporation in the business of manufacturing and marketing consumer health products, J&J is aware of the safety concerns posed by TiO2, she adds.

“Despite knowing that safety concerns with additives are material to reasonable consumers, J&J regularly and intentionally omitted, and continues to omit, material information regarding safety concerns associated with consuming the TiO2 in Tylenol.”

J&J gains greater share of market through omissions, lawsuit alleges

Through its deceptions, J&J was able to gain a greater share of the over-the-counter pain medication market than it would have otherwise, the lawsuit states.

Morrison is looking to represent anyone in the United States who bought Tylenol in the past four years, plus a California subclass.

She is suing for fraud, breach of warranty and unjust enrichment. She’s seeking certification of the class action, damages, fees, costs, an order requiring a corrective marketing campaign, and a jury trial.

Meanwhile, the popular candy Skittles also allegedly contains the known toxin titanium dioxide and is unfit for human consumption, a new class action lawsuit claims.

Skittles is not the only product to reportedly contain titanium dioxide, however, with the toxin appearing in a number of other food items and consumer goods, including Great Value ice cream, Chips Ahoy! cookies, and Lucerne brand cottage cheese, among others.

  5. Lucy Elisabeth Patiala says:

I had a nickel and titanium stent placed in my left leg. Of course the physician never asked if I was allergic to any metal and after months of research and a patch test by a dermatologist, it was proven to him that I have a nickel allergy. This has caused no end of problems an,d I will not go into them because it would take a very long time. The reason for my comment is that after being started on an antidepressant, I had a really bad reaction which was rashes again, muscle weakness, dizziness, etc.. After making some phone calls, I found out that the medication contained titanium dioxide, which I am allergic to. This was not anything sudden but after 2 years of suffering, I found that Tylenol has the same ingredient. Can you help?
