False advertising OTC medications, supplements class action lawsuits overview: 

  • Who: Consumers filed class action lawsuits against several over-the-counter supplement and medication manufacturers and sellers recently, including Bayer and Rite Aid, among others. 
  • Why: The false advertising lawsuits revolve around allegations that, among other things, the over-the-counter supplements and medications don’t work as advertised or aren’t honest about their ingredients. 
  • Where: Consumers have filed complaints against drug makers nationwide. 

Consumers have taken aim recently at the manufacturers of over-the-counter medications and supplements over allegations the drug makers falsely advertise their products.

Class action lawsuits targeting drug makers and sellers revolve around, among other things, allegations that over-the-counter supplements and medications don’t work as advertised or aren’t truthful about the ingredients they are made of. 

The claims, which are currently making their way through federal courts, occur around the same time a new study published last month by The New England Journal of Medicine revealed taking daily vitamin D supplements is not necessary for otherwise healthy adults

Walmart false advertising lawsuit claims company misleads consumers about weight loss benefit of Spring Valley Garcinia Cambogia supplements

Last month, a pair of consumers accused Walmart of making false and misleading claims about the weight loss benefits of its Spring Valley Garcinia Cambogia supplements. 

Walmart falsely advertises that the Spring Valley Garcinia Cambogia supplements are an effective tool for weight loss management, the consumers argue.

The consumers claim that, in reality, the supplements contain hydroxycitric acid and chromium picolinate, which they say are “scientifically proven to be incapable of providing such weight-loss benefits.”

One a Day false advertising lawsuit claims company falsely advertises Multivitamin Natural Fruit Bites as ‘natural’

Also last month, Bayer faced claims it falsely advertises that its One a Day brand Multivitamin Natural Fruit Bites are “natural.” 

The consumer behind the class action lawsuit claims the One a Day multivitamins actually contain synthetic ingredients, making their marketing as “natural” “false, deceptive and misleading.” 

The One a Day Multivitamin Natural Fruit Bites contain the allegedly synthetic ingredients cholecalciferol, niacinamide, pyridoxinehydrochlorid and D-biotin, according to the consumer behind the class action. 

Rite Aid escapes part of false advertising lawsuit claiming it sells cough medicines as ‘non-drowsy’

A class action lawsuit filed against Rite Aid over claims it sold over-the-counter cough, cold and flu medicine falsely advertised as “non-drowsy”, meanwhile, was partially dismissed last month by a federal judge in California. 

The class action lawsuit was one of several brought by consumers against Rite Aid — along with TopCare and Robitussin-maker GlaxoSmithKline — over claims their “non-drowsy” cough medicines actually cause drowsiness. 

Consumers argue the over-the-counter cough medicines contain Dextromethorphan Hydrobromide (DXM) as an ingredient, which they argue is known to cause drowsiness. 

Labrada to pay $625,000 to end claims it misrepresented weight loss benefits of certain supplements

Also last month, Labrada Bodybuilding Nutrition Inc. agreed to pay $625,000 to resolve a false advertising lawsuit claiming the company misrepresented that its Labrada Green Coffee Bean Extract and Labrada Garcinia Cambogia supplements were effective for weight loss. 

The Labrada supplements in question were reportedly featured on the Dr. Oz Show at one time and labeled with boasts including “Fat Buster” and “Fat Loss Optimizer.” 

Despite this, the class action lawsuit argued that the peer-reviewed studies Labrada claimed backed its fat loss claims have since been retracted. 

Consumers who purchased either the Labrada Green Coffee Bean Extract or the Labrada Garcinia Cambogia supplements in the state of California between Feb. 2, 2012, and July 15, 2022, may be eligible to benefit from the class action settlement. 

Vi-Jon expands on nationwide recall involving more than 50 laxative products

In addition to class action lawsuits and settlements, manufacturer Vi-Jon LLC expanded a nationwide recall last month for more than 50 of its laxative products which were sold at leading pharmacies under various brand names. 

The company initiated the recall after discovering that some of the laxative products tested positively for the bacteria Gluconacetobacter liquefaciens. 

The recall expanded on an initial recall conducted by the Tennessee-based Vi-Jon in June for one lot of its CVS Magnesium Citrate Saline Laxative Oral Solution Lemon Flavor product, over Gluconacetobacter liquefaciens contamination concerns.

    My dad used to give me Alka Seltzer for many years as i was growing up along with Mucanex. And when i would go to a Childhood friends house and her mom used to give us sudafed the lil red pills , no wonder i stayed up for days. Now that all this is coming out more and more I understand where my meth addiction came from. so please add me to list . please.
