Curaleaf, C&G, NXNW Class Action Lawsuits Overview:
- Who: Numerous class action lawsuits have been filed against Curaleaf Holdings, while Cannabis & Glass LLC and NXNW Retail LLC reached a $680,000 settlement with consumers.

A wave of class action lawsuits have been filed in Oregon against cannabis company Curaleaf Holdings following claims that a mixup of CBD and THC products allegedly led to illness and deaths.
An attorney representing Earl Jacobe claims his client experienced stroke-like symptoms after consuming what he believed to be a CBD-only product he purchased from Curaleaf, OPB reports.
Counsel claims Jacobe and his wife had to be flown to the hospital on two separate occasions and argue the experience left him physically and mentally weakened prior to him eventually succumbing to an unrelated COVID-19 infection.
The Oregon Liquor Control Commission has recalled hundreds of CBD-tinctures produced by Cura Cannabis Solutions, which Curaleaf acquired last year, after it was discovered they contained undisclosed THC, OPB reports.
Plaintiff Claims She Never Consented To Receiving Promotional Text Messages
Separately, two Washington state cannabis companies announced earlier this month that they reached a $618,000 settlement to resolve claims they violated the Telephone Consumer Protection Act.
Plaintiff Roberta Frank claimed Cannabis & Glass LLC and NXNW Retail LLC sent unsolicited and non-consented promotional texts to her phone, Law360 reports.
Frank claims she gave her phone number to the companies while visiting their retail locations in order to be enrolled in a loyalty program; however, she claims she never consented to receiving any promotional text messages.
Despite this, Frank claims she began receiving unsolicited text messages from C&G and NXNW.
Per the settlement agreement, claimants, which are capped at 10,300, are eligible to receive up to $60 in store credit vouchers at two storefront locations in the state.
The case was referred to mediation back in February 2020 and took over a year of “concerted efforts” by both parties to reach a resolution, according to the proposed settlement.
The class is composed of any individual in the state of Washington who received an unsolicited text message from either of the companies since June 22, 2015.
Earlier this year, a class action lawsuit was filed against Hello Cannabis by a consumer who claims the company invaded their privacy and broke the law by sending promotional texts to numbers listed on the Do Not Call Registry.
