Susan Para of Indiana has filed a lawsuit against Organon USA Inc., the manufacturer of the NuvaRing contraceptive. Her lawsuit alleges that the contraceptive device caused her to develop Deep Vein Thrombosis (DVT), a serious medical problem.
DVT is a blood clot that forms within the large blood vessels of the leg. DVT itself can cause serious pain and impaired function within the leg. More seriously, the blood clot can dislodge or break up in such a way that the blood clot travels through the circulatory system, where it can lodge in critical tissues. This can cause a host of serious problems, like stroke, pulmonary embolism, and certain types of heart attacks. Having DVT can increase the risk of developing these complications.
The plaintiff was diagnosed with DVT in October of 2011, after using NuvaRing since 2007. The lawsuit states that she will need continued medical monitoring. The NuvaRing lawsuit contends that the manufacturer were aware – or reasonably should have known – about the risk of DVT and other problems before Para began to use the contraceptive device. The lawsuit cites required medical testing, which allegedly indicated that the contraceptive had a higher rate of DVT and related complications than other hormone-based contraceptives.
The NuvaRing lawsuit further alleges that despite this awareness, the manufacturers continued to assure the medical community that NuvaRing was as safe as other forms of contraception. The lawsuit holds that these actions made the manufacturers of NuvaRing liable for the damages that Para suffered.Para is seeking to recoup the cost of her medical care, including future medical monitoring. The suit also seeks compensation for pain and suffering, economic loss, and legal expenses. The amount sought is in excess of $75,000.
