Campbell’s soup class action lawsuit overview:

Soup company The Campbell’s Co. is facing a new class action lawsuit alleging it falsely advertises its microwavable soup products as safe to heat in the microwave when they are not.

Plaintiff Margaret Peggi Louise Garvey claims Campbell’s misleads consumers by labeling and marketing its microwavable soup products as safe to heat in microwaves without risk.

Garvey argues Campbell’s microwavable soup products are actually made with polypropylene plastic, which, she argues, releases harmful microplastics directly into the soup when microwaved.

“By falsely promising that the products are microwavable and omitting material information about their ability to shed microplastics under ordinary use, [Campbell’s] has caused consumers to unknowingly expose themselves and their families to dangerous microplastics through everyday food preparation,” the Campbell’s class action lawsuit says.

Garvey wants to represent a nationwide class and California subclass of consumers who purchased Campbell’s microwavable soup products during the class period.

Class action: Campbell’s ‘misled millions of consumers’

Garvey argues Campbell’s is aware of the risks of microplastics and yet still chooses to conceal them and affirmatively represent its microwavable soup products as safe to heat in the microwave.

“Defendant has misled millions of consumers and profited at the expense of their health and welfare, including families seeking convenient, ‘microwavable’ meals for school, work and travel,” the Campbell’s class action lawsuit says.

Garvey claims Campbell’s is guilty of unjust enrichment, breach of warranty and violating California’s consumer protection laws. She demands a jury trial and requests declaratory and injunctive relief and an award of compensatory, statutory, punitive and treble damages for herself and all class members.

Last year, Campbell’s was sued over allegations it falsely advertised its V8 Energy drinks as naturally flavored and plant-based.
