Absolute Dental agreed to a $3.3 million class action settlement to resolve claims that it failed to prevent a 2025 data breach that compromised patient information.
The Absolute Dental settlement benefits individuals whose personal information was potentially compromised in the Absolute Dental data breach between Feb. 19, 2025, and March 5, 2025, including those who received a data breach notice.
The data breach class action lawsuit claims that Absolute Dental failed to implement reasonable cybersecurity measures that could have prevented the data breach. As a result, hackers allegedly gained access to sensitive patient information including Social Security numbers and health data.
Absolute Dental, a dental practice with locations in Nevada, California and Texas, has not admitted any wrongdoing but agreed to a $3.3 million class action settlement to resolve these allegations.
Under the terms of the Absolute Dental settlement, class members can receive up to $5,000 for documented losses resulting from the data breach. These losses can include bank fees, communication charges, travel expenses, credit costs and identity theft damages.
Class members can also receive a one time cash payment from the settlement fund. Exact payments will vary depending on the number of participating class members and the amount of the settlement fund after documented loss payments are deducted.
California class members may be eligible for additional relief under California’s Consumer Privacy Act (CCPA). These class members can receive up to two times the cash fund payment.
The deadline for exclusion and objection is June 9, 2026.
The final approval hearing for the Absolute Dental data breach class action settlement is scheduled for July 30, 2026.
To receive settlement benefits, class members must submit a valid claim form by June 18, 2026.
