iHeartMedia subscriber data class action lawsuit overview:

iHeartMedia knowingly discloses the personally identifiable information of its digital subscribers to Facebook without obtaining the proper consent to do so, a new class action lawsuit alleges.
Plaintiff Gloria Talley claims iHeartMedia shares its digital subscribers’ Facebook ID and “computer file containing video and its corresponding URL viewed” by them to Facebook-parent company Meta Platforms.
Talley argues iHeartMedia is violating the Video Privacy Protection Act (VPPA) by “disclosing its digital subscribers’ Personal Viewing Information to Facebook without obtaining proper consent.”
“VPPA prohibits ‘video tape service providers,’ such as iHeart.com, from knowingly disclosing consumers’ ‘personally identifiable information,’ … without first obtaining express consent in a stand-alone consent form,” the iHeartMedia class action states.
Talley wants to represent a nationwide class of iHeartMedia digital subscribers who have had their personal viewing information disclosed to Facebook by the media corporation.
iHeartMedia profits by sharing digital subscribers’ personal viewing information with Facebook, class action says
iHeartMedia uses the personal viewing information of its digital subscribers to “build more targeted advertising on its website which, in turn, generates greater revenue,” the iHeartMedia class action alleges.
Talley claims iHeartMedia, ultimately, reaps a profit at “the expense of its digital subscribers’ privacy and their statutory rights under VPPA.”
“Without obtaining consent from its digital subscribers, Defendant profits from its unauthorized disclosure of its digital subscribers’ Personal Viewing Information to Facebook,” the iHeartMedia class action states.
Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief, along with an award of restitution and punitive damages for herself and all class members.
A similar class action lawsuit was filed in November against NBCUniversal Media by a consumer arguing the company shared the personally identifiable information of its today.com subscribers with Facebook without consent.
