NBCUniversal Media discloses the personally identifiable information of its Today.com digital subscribers with Facebook without having the proper consent to do so, a new class action lawsuit alleges.
Plaintiff Sherhonda Golden claims the Video Privacy Protection Act (VPPA) prohibits NBCUniversal from knowingly disclosing the personally identifying information of its consumers without proper consent.
Despite this, Golden argues NBCUniversal installed cookies on Today.com that collect and share the personal information of its website and mobile application visitors with the company’s third-party business partners.
NBCUniversal accused of installing Facebook Pixel on Today.com website
NBCUniversal installed what is known as the Facebook Pixel code on Today.com and its mobile application to track and disclose to Facebook when digital subscribers enter and what media they view, the Today.com class action alleges.
“Thus, without telling its digital subscribers, Defendant profits handsomely from its unauthorized disclosure of its digital subscribers’ Personal Viewing Information to Facebook,” the Today.com class action states.
Golden claims Today.com shares its digital subscribers’ personally identifiable information with Facebook “at the expense of its digital subscribers’ privacy and their statutory rights under the VPPA.”
She demands a jury trial and requests declaratory and injunctive relief along with an award of punitive damages for herself and all class members.
Golden wants to represent a nationwide class of consumers who have a digital subscription to a website owned and/or operated by NBCUniversal and who had their personal viewing information shared with Facebook.
A number of similar class action lawsuits have been filed this year against companies accused of unlawfully sharing the personally identifiable information of their customers and/or digital subscribers with Facebook.
