Honda class action lawsuitA federal class action lawsuit has been filed against Honda claiming its 2003-2007 Accords and Civics have defective paint that delaminates, causing the vehicles to appear faded or to have peeling paint.

The Honda Civic/Accord paint class action lawsuit was filed by two Plaintiffs, including a New York resident who alleges portions of her 2003 Honda Accord began exhibiting “areas and splotches of deterioration and eventually grey or white areas where the vehicle’s original paint had delaminated. Over time, the paint delamination has increased in severity and extent, covering several of the vehicle’s body panels.” When the Plaintiff brought her car to a Honda dealership to repair the paint delamination, Honda denied her request because it was beyond the 3 year/36,000 mile warranty.

“In modern vehicles, automobile paint is routinely expected to last the lifetime of the vehicle, such that, absent an accident, a vehicles owner reasonably would not expect to have to spend thousands of dollars to have his or her vehicles stripped and repainted during ownership of the car,” the class action lawsuit says. “Honda, however, has manufactured vehicles with a defective paint or paint application, that leaves vehicle owners with a vehicle of unacceptable appearance. In addition, the delamination of the paint from the vehicle’s body panels, exposing the vehicle to enhanced erosion.”

The Honda paint class action lawsuit is brought on behalf of all California and New York owners of a model year 2003-2007 Honda vehicles. It is seeking actual damages and losses sustained by Class Members and other relief for breach of express warranty, breach of implied warranty of merchantability, and violation of California’s unfair competition law.

    I have 2008 Civic Si in Fiji Blue and the clear coat is coming off the far rear of the roof. I took it to a Honda dealer who told me onl ythe district manager can OK paint warranties. He came is a couple days later and said Honda would not cover this failure because the roof had been repainted. I find this hard to beleive. I did by the car in Jan. of 2011. None of the reports I had done on the car prior to purchase showed any history of damage or repaint. Sounds like a cop out to me. Not sure what I am going to do at this point, but very disappointed and believe this lawsuit should be expanded based on what I am seeing with later model cars as well.

    My 2006 blue Honda Civic started having problems with the paint in 2010 at around 75,000 miles on it. I took it to the dealer and they said I was past the mileage and wouldn’t fix it. The clear coat has been peeling off for two years now on the roof, trunk and top sides and the paint is discoloring on the roof and trunk. On the hood my paint looks like it has cracks on it. My poor car looks terrible! Please help!!

    Have a 2008 Civic with paint damage around the trunk. Mostly on the vertical portion of the trunk. Talked to the dealer 2 years ago and they admitted something wasn’t right. They would only cover part of it, so I decided to hold out. Received a letter in the mail from Honda and it would only cover the hood, which has minor issues. Not gonna waste my time with the dealer. I have faith in the case above!

    I have a 09 civic and the roof fading. Have keeped it cleaned waxed it washed it. And it’s only 3 years old

    My 2008 honda civic looks like it has leprosy. Received extended warranty this week & took my car to dealer. Told my car doesn’t qualify because the defective paint is on the roof and trunk, not the hood & side panels. Funny because the Odyssey extended warranty issued in 2008. covered all horizontal surfaces. Was told my faulty paint problem was from the car wash. How come other cars taken to the car wash have no paint issues?!

    same here i have a 2007 blue honda civic and the paint on the roof is coming off . and on the hood and fender too.

    1998 Acura CL 3.0 – purchased new. Paint is now “crazing/cracking” and is growing by leaps and bounds. Same run around -dealer: paint wearing out, normal for age. Call to Auto Armor as recommended by dealer–no reply. Two independent shops indicate faulty product/application which should be covered by Honda Motors (Acura). After seeing all the run around others are getting, I’m thinking of going directly to Small Claims Court. Anybody tried this? Results? BTW, wikipedia indicates all CL’s were built in Maryville, Ohio at Honda’s plant which also makes Acura Tl and Honda Accord.

      Did you ever get anywhere my Acura rsx has failing paint it’s recalled for Hondas but not Acura which is crazy!

    My 2001 Honda Accord just started having this problem about a year ago. Now, it covers about 1/4 of my car. A lawsuit needs to cover Honda’s starting in 2000. It is not just the 2003-2005 models.

      Can you extend the manufacturer years? Ours is a 2000 Accord and the paint looks horrible over about 1/3 of the car. Please reconsider including cars from 2000 on. Ours has been well cared for but the clear coat failed and has ruined the value of the car.

      8/99 civic lx has terrible paint issues too.,I want a good contact number to get it fixed from Honda?

      The lawsuit should go back to 1998. That is when Honda began to have problems with paint and automatic transmissions. The 1998 is the same generation as the 2000.

    I did wax my car 2-3 times a year and it’s still delaminating. It all started as a grey cloudiness on my 2000 Accord Coupe. It’s not a matter of upkeep. It’s a matter that the paint sucks.

    Mine is a Honda Civic 2007. I left the dealers parking lot with 24 miles on it. Now with a year left to pay on it the roof is a disaster. The paint is peeling off and white spots are starting to appear on the truck. I went to the dealership in Snellville, Ga before my 100,000 mile warranty ran out and spoke to the service dept about it. They all looked at it and agreed that it was not normal. The warranty dept refused the claim and later I spoke to a gentleman on the phone at the warranty division (not the man in charge) and]
    he said that it was environmental (?). Isn’t paint suppose to
    endure the environment? Anyway I want my car repainted correctly and I think Honda should pay for it. Since I purchase this car I have had various strange things go wrong, all covered by the warranty. I feel that I bought a bad car and will probably never buy a Honda again. This was my first brand new car.

      I have a 2010 honda civic and have already had the front quarter panel and the entire roof painted and now the top of the trunk is showing white spots the law suit should continue on for honda owners because even though this lawsuit is thru 2007 Honda still refuses to make a paint job that lasts the life of the car!!!!!!!!!!
