Top Class Actions viewers are starting to receive checks and gift cards in the mail from a Harbor Freight Tools deceptive pricing class action settlement.

Consumers have received checks worth as much as $607.47 and gift cards valued at $160 from the settlement.

In March, Harbor Freight Tools and consumers reached a settlement over a class action lawsuit claiming that the tool company falsely advertised “normal” prices for products that were higher than an advertised “sale” price, when the item had never been offered at the original, higher price.

Consumers claimed that this practice misled them into thinking that the item was on sale and they were getting a deal. 

Though Harbor Freight Tools agreed to the settlement deal, they maintain that they complied with all applicable consumer protection, advertising, and business laws, and that their conduct was not a misrepresentation as claimed by consumers.

The settlement does not require that the company admit any legal fault or liability, and the court has not determined whether or not the company was at fault.

 

Plaintiff Jeffrey Beck claimed that Harbor Freight Tools practiced false advertising by stating certain store items were on sale when they were not. Allegedly, the company knew consumers would think they were getting a deal on the items labeled in this manner, and would be more likely to purchase them than they otherwise would be had the items only been advertised with their actual offering price.

Beck alleged that consumers often use sale prices to make purchasing choices because they feel that a drop in price indicates that they are getting more value for their money, receiving an item for less money that they might have otherwise spent more on. The plaintiff stated that Harbor Freight Tools financially injured consumers because the company denied them what was advertised as the true benefit of their purchase.

Additionally, he claimed that many consumers would not have made their purchases had they known that the items were not offered previously at a higher price, and that he and other similarly affected consumers were financially injured as a result.

To support his allegations that the Harbor Freight Tools items were falsely advertised as being on sale, he claimed that the company never offered the products at the listed, higher “comp at” price, which is at odds with a law that requires an original price to be offered for at least 28 out of 90 days for which a product is for sale.

The deadline to file a claim for the Harbor Freight Tools fake sale class action settlement was Aug. 7, 2017.

    I submitted credit card receipts
    – never received anything and I’m getting tired of waiting because it’s now mid September. At least am glad to know there are others like me.

      We also got all our receipts together scanned and emailed them. As of today I have received nothing. We have spent a lot of money at harbor freight over the years. It would be nice if we can get some back.

    I did option B. I spent a few hours combing through my old CC receipts and scanning everything. I provided them with both a scanned pile of receipts and a nice excel spreadsheet with the dates of purchases that I had receipts for and the amounts. It was a decent sized amount, over 3 grand.

    I submitted this well before the closing date and never heard anything back.

    I have been in contact with the claims administrator a few times now. The first time was just to verify that they had received my info. The second time was to verify they had not sent the gift card and I never received it. They said they were in the process of sending them out and they could not exactly tell me when any person would be getting theirs.

    I wonder if they are being sleazy and sitting on the payment, collecting interest….

    9/10/2018

    Submitted claim with copies of receipts for purchases made at Harbor Freight

    during the period indicated for$5353.83 for which I indicated I would prefer the

    gift card option which would be $1606.15. I mailed it at the US Post Office on the

    last day for submission. It was postmarked while I was at the Post Office.

    I think those in charge of disbursements have made a HUGE mistake. I think they know some of US know this and they don’t know what to do next. For example: Suppose a claimant to option B (30% of total in form of gift card) sent in receipts amounting to $100. This person would receive $30, originally. Now, under the new arrangement, the claimant would receive $60. People who didn’t go to the trouble of gathering and uploading their receipts and only sent in a claim form received $160? So they are going to get $100 more than the person I described above? I smell a very large rat, people. Totally unacceptable. This is BOGUS and they know it. There should be a lawsuit about this lawsuit. If the disbursement folks want to add $150 on top of the percentage owed, then that would be a fine solution. Our friend in the example above would receive $210. Everybody is happy.

      That’s the 1st thing I thought when I saw that Option C folks were getting $160. They upped the percentages for Option A and B people but the amount that they upped them wasn’t much. Why would you give any excess to people with no proof anyway?

      Same here. I’m should be receiving about $1,500 since I submitted receipts and chose gift card. Is now August 1st, 2018.

      Was just looking over the settlement web page and saw that for people who sent in the claim and used both option A & B, there is not a time as to when they will be sending out the gift cards yet. I betting that since if a customer had both their saved receipts and also had copy of their credit card/bank statements, it is taking them longer so they can comb through both and deduct duplicates. Say if you had a receipt for example of 500 and then submitted your bank statement with a 500 charge, they would not be both eligible because it is only one “sale” .

    I filed the paperwork within the dead lines and never received any settlement for the harbor freight class action lawsuits. I even have every reciept from 2013 till now.

    Gift Cards for the Option A and Option B, all are now on hold with no date given.

    Based on being given a mailing date of no later than 6/26. On Friday 6/29, I reached out to the Class Administrators and then the Class Counsel for answers. Here are the answers I received.

    Here is what I received from Class Administrators:
    “There has not currently been a date set for when the Option A & B gift cards will be mailed. We are still awaiting approval from Class Counsel to mail the gift cards.”

    So, being told they are waiting on approval. I sent the Class Counsel an email.

    Here is what I received from Class Counsel:
    “There are some issues with the administrator that we are working through at the moment, so distribution is temporarily on hold. We are continuing to work hard for you and the other class members so that payments can issue as soon as possible. Thank you for your patience.”

    So, it does not look like we will be getting the gift cards anytime soon.

      I bet you there is not enough money to pay Claims A and B.. Option C was suppose to be $10 and they all got $160 with no proof…… I bet you that was an error!

      Here is some info I found online.

      > Due to an excess in settlement funds the award amounts were increased in the following order:

      >1. Group A amounts were raised from 20% to 54% in cash and from 30% to 60% in gift card.

      > 2. Group B amounts were raised from 10% to 18% in cash and from 12% to 18% in gift card.

      > 3. The remaining funds were divided among all Group C Class Members

    We still have not received anything. My dad got his $160 gift card. But we spent more than he did!!! How do I find out why we didn’t receive ours?? As of June 26,2018!
