Top Class Actions viewers are starting to receive checks and gift cards in the mail from a Harbor Freight Tools deceptive pricing class action settlement.

Consumers have received checks worth as much as $607.47 and gift cards valued at $160 from the settlement.

In March, Harbor Freight Tools and consumers reached a settlement over a class action lawsuit claiming that the tool company falsely advertised “normal” prices for products that were higher than an advertised “sale” price, when the item had never been offered at the original, higher price.

Consumers claimed that this practice misled them into thinking that the item was on sale and they were getting a deal. 

Though Harbor Freight Tools agreed to the settlement deal, they maintain that they complied with all applicable consumer protection, advertising, and business laws, and that their conduct was not a misrepresentation as claimed by consumers.

The settlement does not require that the company admit any legal fault or liability, and the court has not determined whether or not the company was at fault.

 

Plaintiff Jeffrey Beck claimed that Harbor Freight Tools practiced false advertising by stating certain store items were on sale when they were not. Allegedly, the company knew consumers would think they were getting a deal on the items labeled in this manner, and would be more likely to purchase them than they otherwise would be had the items only been advertised with their actual offering price.

Beck alleged that consumers often use sale prices to make purchasing choices because they feel that a drop in price indicates that they are getting more value for their money, receiving an item for less money that they might have otherwise spent more on. The plaintiff stated that Harbor Freight Tools financially injured consumers because the company denied them what was advertised as the true benefit of their purchase.

Additionally, he claimed that many consumers would not have made their purchases had they known that the items were not offered previously at a higher price, and that he and other similarly affected consumers were financially injured as a result.

To support his allegations that the Harbor Freight Tools items were falsely advertised as being on sale, he claimed that the company never offered the products at the listed, higher “comp at” price, which is at odds with a law that requires an original price to be offered for at least 28 out of 90 days for which a product is for sale.

The deadline to file a claim for the Harbor Freight Tools fake sale class action settlement was Aug. 7, 2017.

    We filled out all required paperwork and sent in by the due date. However, still have not received our gifts cards. According to our calculations, we have approx. $ 800.00 coming in gift cards. How can we find out if our claim was received and/or processed?

    I reached out to them multiple times yesterday regarding my A and B claims and FINALLY received some concrete explanation.

    ******CALCULATIONS******

    Group A cash: Raised from 20% to 54%
    Group A credit: Raised from 30% to 60%
    Group B cash: Raised from 10% to 18%
    Group B credit: Raised from 12% to 18% credit
    Group C: All remaining funds after the A and B claims were divided equally resulting in the $160.

    In addition, they did provide the dollar amount I was receiving with a breakdown. Though it seems lower than it should be, I will be going back to my receipts to ensure they got the total “You Saved” amount correct. I am STILL waiting on the gift cards and too was told, “all compensation should be mailed out by 12/7”.

    I just got my Option A gift card today.
    It was for about 62% of the “You Saved” amount, not the 30 % originally planned.

    After reading the comments here, it sounds like some people think that they are to be getting the entire “you saved” amount back and that is not the case.
    Funny how people get so demanding when it comes to freebies…..

    I received my gift card on Saturday 11/3/18, it was for about 1/2 of what my total “you saved” about listed on my receipts.

    I still can’t understand how the people who submitted no evidence, and were only supposed to get $10, got $160 instead, and those with their receipts get less!!!!!

    Anyone have an answer on this?

    Disbursements to eligible Class members who did not opt out and who sent in valid and timely Claim Forms has resumed. Final compensation will be mailed on a rolling basis. All compensation should be mailed by November 30.

    Is anyone here interested in pooling small funds into a pool so we can hire legal representation to investigate what’s going on here? This organization is not communicating adequately and owes a money/gift cards to many consumers. I see speculation of misappropriation of funds as well. If I see enough interest in investigating, I’ll put something together.

      I had thought about this, who has ever put together a class action lawsuit against the attorneys of a class action lawsuit. I opted for option B as per the original settlement statement amount I would receive $68. If I had known option C would be a $160 gift card (instead of a $10 g/c as stated) I would have just chosen that instead, no brainer!

    I sent in my paperwork and was approved. I have sent several requests asking where the gift card is all I get back is this:

    Email Dated 8/28/18

    Your claim has been processed and approved. According to our records, you filed under Option A and selected to receive payment via gift card.

    The payments are being sent on a rolling basis. Checks were mailed to claimants who selected a cash payment on April 30, 2018, and gift cards were mailed to claimants who submitted an Option C claim on May 11, 2018. Gift cards for claimants who submitted Option A and Option B claims will be mailed at the earliest possible time. It is not possible, however, to provide a mailing schedule at this time.
