Top Class Actions viewers are starting to receive checks and gift cards in the mail from a Harbor Freight Tools deceptive pricing class action settlement.

Consumers have received checks worth as much as $607.47 and gift cards valued at $160 from the settlement.

In March, Harbor Freight Tools and consumers reached a settlement over a class action lawsuit claiming that the tool company falsely advertised “normal” prices for products that were higher than an advertised “sale” price, when the item had never been offered at the original, higher price.

Consumers claimed that this practice misled them into thinking that the item was on sale and they were getting a deal. 

Though Harbor Freight Tools agreed to the settlement deal, they maintain that they complied with all applicable consumer protection, advertising, and business laws, and that their conduct was not a misrepresentation as claimed by consumers.

The settlement does not require that the company admit any legal fault or liability, and the court has not determined whether or not the company was at fault.

 

Plaintiff Jeffrey Beck claimed that Harbor Freight Tools practiced false advertising by stating certain store items were on sale when they were not. Allegedly, the company knew consumers would think they were getting a deal on the items labeled in this manner, and would be more likely to purchase them than they otherwise would be had the items only been advertised with their actual offering price.

Beck alleged that consumers often use sale prices to make purchasing choices because they feel that a drop in price indicates that they are getting more value for their money, receiving an item for less money that they might have otherwise spent more on. The plaintiff stated that Harbor Freight Tools financially injured consumers because the company denied them what was advertised as the true benefit of their purchase.

Additionally, he claimed that many consumers would not have made their purchases had they known that the items were not offered previously at a higher price, and that he and other similarly affected consumers were financially injured as a result.

To support his allegations that the Harbor Freight Tools items were falsely advertised as being on sale, he claimed that the company never offered the products at the listed, higher “comp at” price, which is at odds with a law that requires an original price to be offered for at least 28 out of 90 days for which a product is for sale.

The deadline to file a claim for the Harbor Freight Tools fake sale class action settlement was Aug. 7, 2017.

    As of June 25 I have received nothing. I should be getting several hundred dollars. I turned in all receipts prior to the deadline, and confirmed with a woman at the law firm that my records had been received.

    Is this a big scam?

    Has the law firm kept most of the money and paid a stipend to a select few just to say they made payments.

    I should have received over a $600 gift card. As of 6-18-18, NOTHING! All of us have waited months to hear nothing, and I know of no way to track any claim. Their lack of infomation is very disturbing.

    Impossible to contact the class action law firm, the nationalpricesettlement phone number is a loop that can’t lead to a person. Did they just pocket all of the money???

    I filed an individual claim with every receipt attached during the class period. The total amount due was about 330.00. I faxed the document twice and mailed it just to be sure. As of June 11, 2018, I have not received any settlement.

    Called the attorney’s office to inquire about my H.F. settlement of $725.00, well they informed me that I uploaded a blank document,and that I won’t be getting a settlement, you think they would contact me in regards to this matter, they have my phone number, email, and address, just wow!

    I sent in all my credit card statements that had harbor Freight purchases for the time frame indicated.
    I have not seen or heard anything yet. It was only going to be $160 gift card if I remember correctly

    We still have not received ours We requested a check for the payment. It was filed under my boyfriend’s name since he made the purchases.

    There should be a second disbursement from the harbor freight class action suit. Not sure whats going on. There is a third disbursement that is being sent out to the $10 no receipt claimants. The are receiving $160 gift cards. Seems they have by passed the second disbursement. If there is extra money left over, which there has to be for them to send out $160 gift cards instead of $10 gift cards there should have been a second disbursement to the claimants that sent in receipts

      As of 7/1/18 I have not received mine and I am expecting a little over $530.00 . From what i remember reading, they still will be mailing out gift cards, which is what i requested through July. It is a little unnerving to see people get theirs and have not seen any high dollar amounts as of yet. high meaning over 250.00 . Anyone know how we can contact and get a real live person to look into it? thanks
