Flea & Tick Product False Advertising Class Action Lawsuit

By Mike Holter

Advantage Flea & Tick ProductsA class action lawsuit has been filed on behalf of dog and cat owners alleging, among other things, that Bayer Healthcare, LLC and Merial Limited regularly make false and deceptive claims in advertisements for their flea and tick products.
According to the class action lawsuit, Bayer and Merial collectively sell approximately $2 billion in flea and tick products annually, including Bayer’s line of Advantage, Advantix, K9 Advantix and Advocate products, and Merial’s line of Frontline and Certifect products. These products are sold as treatments for dogs and cats suffering with fleas, ticks, adult flea eggs, larvae, mosquito, heartworm, ear mites and sarcoptic mange. While each one of individual products targets only a limited subset of the pet aliments, all of the products target fleas and their larvae.
The problem, the flea and tick product class action lawsuit states, is that Bayer and Merial make false and/or misleading claims about what these products do. These allegedly false advertising claims include that the products:
* are self-dispersing and cover the entire surface area of the dog or cat’s body when applied in a single limited spot;
* are effective for one month and require monthly application to continue to be effective;
* do not enter the blood stream of the pet and instead move across the pet’s skin to cover the pet; and
* are waterproof and remain effective following shampoo treatments, swimming, or after exposure to rain or sunlight.
The Bayer and Merial Flea and Tick Product Class Action Lawsuit is seeking to recover damages on behalf of all consumers who purchased the products, as well as an injunction barring Bayer and Merial from continuing to misrepresent what their flea and tick products can do.

    I lost two dogs in 2019. My third dog is showing similar signs of neurological issues. Amazon just now sent me an email not to use the FRONTLINE Plus! Stating it was counterfeit. The product should be off the market and Amazon should be held responsible for allowing the product to be sold.

    We would like to be added to the Lawsuit. Our Vet recommended Seresto for our two Pit Bulls for fleas this Summer. Sammy, our male had no bad reaction and it worked. Emma quickly developed oily fur. About 2 weeks into her treatment I noticed black lesions on her skin under her fur. The Vet never said anything about this. She has been on different types of flea and tic collars and topicals. This has never happened before. Her fur also smelled foul. We immediately removed it and gave her a bath. The lesions have kept appearing. She is short haired. I have called her Vet about 8 times over this since the beginning of August. No return call. I washed her again this morning and every few days, as the lesions come to the surface and weep a black and bloody liquid. I those places her skin also falls off. This morning I was in tears as I saw these things and the damage this collar has done to my precious dog. Some have healed, but obviously there were hundreds of them>.since the beginning of August. I do not know if she is in pain, but she does not seem happy. I am so angry at the Vet’s office, I left to screaming messages this morning for them to have Emma’s records ready, as my husband will pick them up today. I don’t know how long it will take for them to leave her body, or what other damage they might have done. We love Emma so much, and Sammy, they are Family…..

  9. Jane Jasterbowski says:

    My beautiful 8 year old Rottweiler “Bear” after 6 months of wearing the Bayer Seresto Flea Collar starting having symptoms of an allergic reaction ‘eye drooping, drooling, licking” we noticed some type of mass under this tongue; while waiting to see the vet and within days he developed a golf ball size tumor under his jaw bone that was growing by the day, his teeth began to fall out and he stopped eating. the vet told us it was very aggressive sarcoma that had metastasized and the jaw bone was too involved, there was nothing they could do and gave him 8-12 weeks. We tried to feed him by hand but there was so much blood. We had no choice but to put him down. I wish I could upload photo’s of the devastating consequences of this collar. I would like to be part an any law suit against Bayer.

  10. Rachel Steer says:

    I would like to be added to this lawsuit. My miniature poodle almost died yesterday after using PetArmor Plus. The day after using it, he became lethargic and developed seizures. I got him into the vet within an hour where it was determined that he was having a toxic reaction from the flea medicine. They gave him fluids, and told me to bathe him well. We are going back for repeat labs in a week to determine whether he suffered permanent damage to his organs. He barely survived last night. I pray that he fully recovers.
