Target biometric privacy class action lawsuit overview: 

  • Who: Arnetta Dean filed a class action lawsuit against Target Corporation. 
  • Why: Dean claims Target unlawfully collected the biometric data of its customers in the state of Illinois. 
  • Where: The class action lawsuit was filed in the Circuit Court of Cook County, Illinois. 

Target unlawfully collected the biometric data of thousands of Illinois residents who visited its store locations, a new class action lawsuit alleges. 

Plaintiff Arentta Dean’s class action lawsuit claims Target stores are outfitted with camera and advanced video surveillance systems that “surreptitiously collect, possess or otherwise obtain” the biometric data of customers, as reported by NBC Chicago

Dean argues this alleged biometric data collection is done without consumers’ knowledge and is in violation of the Illinois Biometric Information Privacy Act (BIPA). 

“Target’s practice of collecting, storing, and using individuals’ Biometric Data without obtaining informed written consent violates all three prongs of … BIPA,” the Target class action says. 

Dean wants to represent a class of Illinois residents who had their biometric data collected, captured, received, obtained, stored, sold, leased, traded, disclosed, redisclosed, disseminated and/or otherwise profited from and/or used by Target in Illinois without their consent. 

Target misappropriated value of consumers’ biometric data, class action claims

Dean argues Target directly harmed consumers by depriving them of control over their “valuable information,” which she argues “misappropriated the value of their biometric identifiers and/or biometric information.” 

“Through its unlawful conduct, (Target) received and retained a benefit it otherwise would not have achieved,” the Target class action says.

In addition to allegedly violating BIPA, Dean claims Target is guilty of unjust enrichment. She demands a jury trial and requests declaratory and injunctive relief and an award of statutory, compensatory, non-compensatory, exemplary and punitive damages for herself and all class members. 

In another case involving biometric data, Little Caesars agreed to pay nearly $7 million last year to put an end to claims it violated BIPA by using a fingerprint scanner as a timekeeping system without first obtaining employee consent. 

The settlement, which is now closed, offered about $670 per eligible claimant and represents an example of how cases involving biometric privacy can lead to significant payouts for consumers.
