False advertising class action lawsuits overview: 

  • Who: Consumers recently filed class action lawsuits against TC Heartland LLC, Stiiizy Inc., Panera, Big Heart Pet Brands, Prime Hydration LLC, Philip Morris International and Swedish Match North America LLC. 
  • Why: The class action lawsuits involve false advertising claims. 
  • Where: The false advertising class action lawsuits were filed in U.S. federal courts. 

Consumers recently filed class action lawsuits against companies accused of falsely advertising their products to consumers. 

The allegedly falsely-advertised products include stevia sweetener, cannabis, bagels, dog food, energy drinks and nicotine pouches. 

Splenda stevia product falsely advertised as 100% natural, class action claims

A consumer filed a class action lawsuit against TC Heartland LLC earlier this month over claims the company falsely advertises Splenda Naturals Stevia Zero Calorie Sweetener as 100% natural

The class action lawsuit argues the Splenda stevia product is labeled as “100% natural” despite containing the non-natural, synthetic ingredients stevia leaf extract and erythritol.

“Reasonable consumers lack the meaningful ability to test or independently ascertain the truthfulness of foods labeled as ‘all’ or ‘100’ natural, especially at the point of sale,” the class action states. 

Class action alleges Stiiizy falsely advertised cannabis products as legal Delta 8 hemp

A pair of consumers filed a class action lawsuit against Stiiizy Inc. earlier this month over claims the company falsely advertises its cannabis products as Delta 8 hemp

The class action lawsuit argues Stiiizy sells cannabis products labeled as Delta 8 hemp that contain 200% of the amount of THC that would make them legal to be sold in Illinois or Missouri. 

The consumer argues Stiiizy, by virtue of misbranding the products, misleads its customers about cannabis products that should be regulated as a controlled substance and don’t fit the legal description of the industrial hemp market. 

“As one of the nation’s largest cannabis product manufacturers, Stiiizy is well-aware of the THC requirements for all types of products, including Delta 8, CBD and traditional cannabis yet is willfully disobeying those requirements for its own profit and to the detriment of consumers,” the class action states.

Panera falsely advertises bagel as primarily containing sprouted grains, class action claims 

A consumer filed a class action lawsuit against Panera and  Kym Kanow, West Covina Panera Bread owner and general manager, this month over claims the restaurant falsely advertised one of its bagels contained more sprouted grains than was actually the case. 

The class action lawsuit claims Panera’s Sprouted Grain Bagel Flat, despite advertising to the contrary, contains more regular non-sprouted grains than sprouted grains. 

“(The plaintiff) had a reasonable expectation that sprouted grain constituted the primary, if not exclusive, source of grain in the product,” the class action states. 

Class action claims Pup-Peroni dog food does not contain real beef as advertised

A consumer filed a class action lawsuit against Big Heart Pet Brands earlier this month over claims the company falsely advertises its Pup-Peroni dog food product contains real beef

The class action lawsuit argues Pup-Peroni actually contains feed-grade beef as its top ingredient, which the consumer behind the class action claims is lower quality and can potentially be harmful. 

“The public expects beef is subjected to inspections to ensure quality attributes, such as (1) sourcing only from healthy animals, (2) limited use of additives and (3) careful review of processing methods,” the class action states.

Prime energy drinks contain more caffeine than label indicates, class action says

A consumer filed a class action lawsuit against Prime Hydration LLC in April over claims the company falsely advertises the amount of caffeine in its Prime energy drinks. 

The class action lawsuit argues Prime labels its energy drinks as containing 200 milligrams of caffeine when, in reality, the beverages contain 215-225 milligrams of caffeine. 

The consumer claims the alleged mislabeling especially puts school-aged children and teenage boys at risk, arguing they are the demographic most interested in purchasing the energy drinks. 

Philip Morris falsely advertises ZYN nicotine pouches as healthy, class action alleges 

An anonymous plaintiff filed a class action lawsuit against Philip Morris International Inc. and Swedish Match North America LLC in late March over claims Philip Morris falsely advertised ZYN nicotine pouches as healthy. 

The class action lawsuit claims Philip Morris also falsely marketed the ZYN nicotine pouches, Philip Morris-acquired company Swedish Match North America created, as a nicotine-cessation device. 

“By creating a product that could be used almost anywhere, and at any time of day, defendants promoted and pushed nicotine addiction on unsuspecting youth and young adults,” the ZYN class action states.

    When prime drinks first came out the kids were going nuts over them . Sold out in all the stores. I bought my share of them. I bought online at either Target,, Amazon or Walmart. Please ADD ME
