CitiMortgage Loan Modification Class Action

CitiMortgageAngry homeowners have filed a class action lawsuit against CitiMortgage, Inc. alleging the mortgage-and-loan company not only failed to deliver on its promises of providing borrowers with reduced loan payments, but also “financially devastated” them.  

 

According to the class action lawsuit, CitiMortgage told homeowners that it could help them reduce loan payments by putting them in a trial mortgage modification program, based on the company’s participation in the U.S. Treasury Department’s Home Affordable Modification Program (HAMP), that would become permanent if the homeowner made reduced payments during the three-month trial period. However, even though homeowners made the monthly reduced payments that CitiMortgage asked them to make, and complied with the company’s requests for various documents in a timely manner, CitiMortgage allegedly denied homeowners permanent modification plans. This put some homeowners in even bigger financial hardship than when they entered the trial modification, despite doing everything CitiMortgage requested of them.

 

“Consumers that were rejected from permanent modification plans through no fault of their own should find themselves in no worse position than they entered it. Instead, [CitiMortgage’s] failure to honor its agreements and its misrepresentations and omissions about a program enacted to help homeowners reduce their payments and keep their homes have left Plaintiffs and Class Members financially devastated,” the lawsuit says.  

 

The CitiMortgage class action lawsuit is brought on behalf of all persons in the United States whose loans have been serviced by CitiMortgage and who, since April 13, 2009 through the resolution of litigation, have complied with their obligation under a trial loan modification program and have not received a permanent modification pursuant to the loan modification agreement and have been harmed because of it.

 

The lawsuit is seeking, among other things, class certification, restitution and actual damages for injuries suffered by class members. A copy of the CitiMortgage Class Action Lawsuit can be read here.

    I was apart of the corruption with citimortgage, Interest $19.262.60 and $15,086,89 for Escrow add total to my account of $34,349,49 , Then sold the mortgage leave death of on my home

      I would be grateful with some help,I put it on the market it could not sold because price with the added escrow, The agent told me so I have to take it off the market became the price is too hight.

    We had a foreclosure filed on us in ’08; We came to a modification agreement with Citimortgsge back in ’09 (40 year, 2%, fixed rate) . We were asked to make 3 qualifying payments which turned to 12 and then 15 (each payment went towards invest only). We then made a year’s worth of modified payments and then Citimortgsge decided to change our payment back to the original payment (before modification). They knew we couldn’t pay it and they then filed another foreclosure against us.

    We never received a copy of the modification. The notary said she forgot our copy but would mail it to us. The mortgage amount was for more than the value of the house. Citimortgage sold the loan off soon after filing. When we went to mediation the plaintiff could not produce a copy of the modification and the foreclosure was based on a 2006 mortgage agreement. The plaintiff stated that we signed an adjustable rate mortgage (any would we do that)!

    Citimortgage new that they were going to screw us over!

    I was also a victim of their company. They told me not to pay fro 3 months to get the modififation. Then they denied it and tacked on fees after fees.

      I’m a victim of Citimortgage, they have falsified some documents saying I took out a second mortgage on my home I found out about this when I tried to sell my home. They even put First American Mortgage on the false documents hoping that I would find out. So I called First American Mortgage they informed me that they have no dealings with my loan. They told me I need to call Citimortgage or HUD .Which Citimortgage won’t talk to me. So I called HUD they said Citimortgage borrowed money to bring my mortgage current which was a lie. So they want me to find out what Citimortgage did with the money. Then Hud sent me a blank form to fill out. To me they’re asking me to fill out paper work like I am borrowing money so I didn’t fill it out. I think I need a lawyer or legal advice.

        Get a class action lawyer, go to the supreme court. They buy out every lawyer and crooked judge in Alabama

    After making all of my mortgage payments on time, CitiMortgage filed a Foreclosure on my home in Killeen, Texas, Feb. 2011. They rejected my mortgage payments, then mailed me a Foreclosure letter. I paid over $17,000, in various fees through 2014 to keep my home and setup with a reputable mortgage company. Please help me to get my money returned. Thank you.

    I’ve lost everything because of citimorgage failings to comply with Court orders leaving me homeless. Is there anyone who can look at my papers. It’s probably too late but I would like answers.bim just picking up the pieces of my life.

    just wanted to add insurance to my escrow. Customer service at Citi Mortgage said I had the be behind on my mortgage to qualify for modification ( said that’s what I had to do to get insurance added to mortgage)
    Fast forward a year..diagnosed with cancer, job lost, medical bills…had to file bankruptcy.
    Called to get an approval to push back a payment. I make mention about escrow and start the process. Customer service at Citi said to contact insurance agent and let them know payment will be coming from them. Two weeks later I got a cancellation notice from insurance….again called citi mortgage. They assured me that they were going to pay. They didn’t. Insurance cancelled. Insurance tripled due to my bankruptcy and Citi adds insurance to my monthly payment to cya citi. For there mistake. I’ve been through the modification process at least five times. I’m House was foreclosed on last Aug. but I’m fighting tooth and nail to stay in it.
    How do you go from owing $120,00 to $250,000 and foreclosed on? $$$ spent on attorneys…

    A correction in my previous comment regarding CitiMortgage and my foreclosure it should say Cindy Gardner admitted that I made all my payments and that I did nothing wrong and then 2 Days Later denied saying that or having that conversation with me I asked her if the conversation was being recorded and all she so does randomly but as I stated in my other post another girl by the name of Vanessa told me all my payments in fact in June of 2010 I made a large payment of $10,763 my attorney is asking for all that proof of those payments and asking CitiMortgage to stop the foreclosure and give me a loan modification again thank you let me know if you can help me if anybody reads this please call me 651-500-4279 thank you

    Thank you I’ve been fighting with CitiMortgage for over 10 years and spent over $56,000 in attorney fees I was put on a trial loan modification back in 2008 and 9 I made all my payments of over $57,000 and then in December after paying for two years they started foreclosure on me and I’ve been fighting ever since a Woman by the name of Cindy Gardner from CitiMortgage admitted 2 weeks ago in August that I made all my payments she found on my payments and that I should have been going through this right from the start and then two days later she called and I asked her where my payments went and she did not hide the conversation we had about the payments the next day I called back and talk to another woman at CitiMortgage and she admitted it all my payments were there I have all my receipts to show my payments but yet they continually try a foreclose on me after I did nothing wrong right from the start also my loan documents are fraud I have the famous Robo signature Linda Green on my assignment what can I do to fight this legally and when I just want to start making payments again I’m not asking for a free house I just want to get back on track 651-500-4279 please reply thank you

      I’m a victim of Citimortgage made all payments and they just took my money. Sent my mortgage to another server and I have a Lein against my home and don’t know why.And no one can give me answers.

    they would answer phone pay them and sent check back made us go though modfey program put $ 30,000 tail end on new loan program.
