CitiMortgage Loan Modification Class Action

CitiMortgageAngry homeowners have filed a class action lawsuit against CitiMortgage, Inc. alleging the mortgage-and-loan company not only failed to deliver on its promises of providing borrowers with reduced loan payments, but also “financially devastated” them.  

 

According to the class action lawsuit, CitiMortgage told homeowners that it could help them reduce loan payments by putting them in a trial mortgage modification program, based on the company’s participation in the U.S. Treasury Department’s Home Affordable Modification Program (HAMP), that would become permanent if the homeowner made reduced payments during the three-month trial period. However, even though homeowners made the monthly reduced payments that CitiMortgage asked them to make, and complied with the company’s requests for various documents in a timely manner, CitiMortgage allegedly denied homeowners permanent modification plans. This put some homeowners in even bigger financial hardship than when they entered the trial modification, despite doing everything CitiMortgage requested of them.

 

“Consumers that were rejected from permanent modification plans through no fault of their own should find themselves in no worse position than they entered it. Instead, [CitiMortgage’s] failure to honor its agreements and its misrepresentations and omissions about a program enacted to help homeowners reduce their payments and keep their homes have left Plaintiffs and Class Members financially devastated,” the lawsuit says.  

 

The CitiMortgage class action lawsuit is brought on behalf of all persons in the United States whose loans have been serviced by CitiMortgage and who, since April 13, 2009 through the resolution of litigation, have complied with their obligation under a trial loan modification program and have not received a permanent modification pursuant to the loan modification agreement and have been harmed because of it.

 

The lawsuit is seeking, among other things, class certification, restitution and actual damages for injuries suffered by class members. A copy of the CitiMortgage Class Action Lawsuit can be read here.

    I too was a victim of CitiMortgage…How do I find out more information about this lawsuit? Even after they foreclosed, the home is still listed in my name. Up to a year or so ago , I still was receiving paperwork from them

    I have also been a victim with CitiMortgage on my property in 2009 I foreclose in 2013 also was in the modification program and due to the lack of paperwork and so forth that they kept saying I didn’t give them and so forth I lost my home and that’s been in my family for years I would also like to get into this lawsuit and who do I contact about this

    I would like to be contacted with information on joining the class action lawsuit. We had filed bankruptcy and had made a loan modification through CitiMortgage. All was approved and payments were sent through a trustee. We have made every payment on time and are now trying to close the bankruptcy case. Now they are claiming the loan modification process didn’t go through so they have been putting the payments to back payments. It has taken us several months of the run around to figure out what they did.

    I would like to be a part of this lawsuit. I called to speak with customer service about the HARP program. All I Wanted was to refinance to lower our interest rate and our payments. I was told that We didn’t qualify because we were current on our payments. I was told to skip payments for 3 months to qualify. I questioned this advice and even made return calls to double check this advice. 2 months into skipped payments and we receive a letter that our loan had been transferred to a govt. Mortgage company. I called to ask why and was told because we were late on our mortgage. I explained what we were told by a citimortgage rep to do and I was told it was too late to do anything. This left us in a very tough place. I filed a complaint at the time but never received a reply. Phone calls went unreturned.

    Does anyone have a contact where I can join the class action lawsuit aganist citi mortgage where they did my modification with a 100,000 deferment and the value at the time was more than owe and they basically said take it or leave it.

    I also need help! We are losing our home, Citi has refused refinance, refused HAMP, refused HARP. They have had people physically show up to intimidate us. They are trying to force us into signing over the deed to them. They add thousands in unexplained fees.

    I was part of the corruption with citimorgage yet I never heard or received anything. We lost our house, they would not do loan modification and we ended up owing more than financed. In addition when house was auctioned citimorgage bought it for over 240,000 and house was not even worth $200,000. Can someone help me find out why we were not included in class action suit or point me in right direction? Thank you

    I experienced the same thing, my initial loan was 89 thousand and after 15 years of payment they said that I owed them roughly a hundred thousand they often lost my paperwork they couldn’t locate it I had to call repeatedly they actually sent a letter saying that they did Miss handle my file as a result my home was foreclosed on when I went to court the woman representing them told me that they would not sue me for the $100,000 that I owe them after having paid 15 years of roughly $900 per month she said that they were doing me a favor and wouldn’t pursue me for that after stealing my home

      Me too. Put me in forclosure after telling me I had to miss 2 payments in order to apply for a loan modification. I was assured they wouldn’t put me in forclosure until I was behind 3 months. I reluctantly missed the two months did the application over the phone and tried to pay my next month payment they said no I’m in forclosure. On the same day I did the application. 2/9. Payment is due by the 15th of the month. There’s so much more they have done too. Especially when I was told I was approved for a modification.

        citimortgage told me from 2009 until 2014 that my mortgage could not be modified because it was not a government loan until 2014 and then I found out after paying attorneys fees for years they had lost the note on the property. we had all the court filings to ask for more time until the Judge said the case was to remain closed and Citi was to pay my attorneys fees, which they never did, the loan was then refilled with new Attorneys and Servicesor and now in fore closure without ever getting a modification. who can I ask for restitution for this as I know most all the information from them was fraud.
