UPMC Nurse Secret Filming Class Action Lawsuit Overview:
- Who: A class action lawsuit against the University of Pittsburgh Medical Center (UPMC) has been certified by a judge.
- Why: More than 200 women and girls claim a former nurse employed by UPMC secretly filmed them while they were in various stages of being undressed and/or while using the bathroom.
- Where: The class action lawsuit is pending in Pennsylvania federal court.
A judge has certified a class action lawsuit lobbied against the University of Pittsburgh Medical Center (UPMC), paving the way for more than 200 women and girls to join a complaint against a former emergency room nurse accused of secretly filming them.
Nine female plaintiffs originally filed the class action lawsuit against UPMC over the alleged actions of Michael Bragg, a former nurse who has been accused of secretly filming his female patients while they were in various stages of being unclothed, reports PennLive.
Bragg reportedly worked at UPMC’s Carlisle Medical Center from January 2016 to April 2019, during which time he allegedly used a hidden camera to film more than 200 of his female patients — including children — while undressed.
The former UPMC ER nurse — who is facing charges including possession and manufacturing of child pornography, aggravated indecent assault, invasion of privacy, and wiretip violations — has also been accused of molesting some of his patients while they were in an inapacitated state, reports PennLive.
“People who were rushed to the emergency room or needed serious medical attention were violated by this man,” Pennsylvania Attorney General Josh Shapiro said in 2019. “This sick sexual predator took advantage of patients when they were at their most vulnerable, in need of care.”
UPMC Class Action Status Affects Individual Claims, Says Rulin
The class action status will be applicable for all trials that are in regards to claims of medical professional liability on the part of UPMC, the judge ruled.
The judge also ruled separate trials will be held to determine damages owed to each individual plaintiff if a jury finds UPMC is liable for the claims lobbied against it, reports PennLive.
Bragg is currently in jail and facing more than 400 criminal charges over the allegations. A damage verdict of $90,000 has already been awarded to one of his alleged minor victims, who claimed in her lawsuit that Bragg shared some of the videos online.
Agents who raided the home of the former nurse in 2019 say they found the secret videos — including some where child patients were using the bathroom — in addition to other illegal imagery, including child pornography, reports PennLive.
Officials at UPMC have reportedly been aiding in the criminal investigation against Bragg.
UPMC settled a separate class action lawsuit for $12.5 million back in 2016, over allegations it conspired with a healthcare provider to inflate the price of insurance plans for small groups.
