Onnit Labs falsely advertises that its Alpha BRAIN® brain health supplements support memory, focus and processing speed, a new class action lawsuit alleges.
Plaintiff Jean Paul Lotz’s class action lawsuit claims a 2016 study conducted by Onnit Labs — which was co-founded by commentator and podcaster Joe Rogan — showed its Alpha BRAIN® brain health supplements perform no better than a placebo.
“Alpha BRAIN®’s claims that it improves focus, mental speed and memory generally are false as demonstrated by its own Onnit Funded Study,” the Joe Rogan class action says.
Rogan, meanwhile, regularly promotes the Alpha BRAIN® brain health supplement to millions of listeners on his podcast, The Joe Rogan Experience, the class action alleges.
Lotz wants to represent a class of consumers who purchased Alpha BRAIN® from Onnit Labs in the state of New York within the applicable statute of limitations.
No ‘statistically significant difference’ between Joe Rogan brain health supplements, placebo, class action says
Lotz argues Onnit Labs — which was sold to Unilever in 2021 — cites its study as proof that its Alpha BRAIN® supplements support cognitive function, despite the results allegedly not finding the claim to be true.
In reality, the study showed that, in tests conducted to measure attention, concentration and processing speed, there was “no statistically significant difference between the Alpha BRAIN® group and the placebo group,” the Joe Rogan class action alleges.
Lotz claims Onnit Labs is guilty of violating New York General Business Law. He demands a jury trial and an award of monetary, statutory and treble damages for himself and all class members.
A consumer filed a similar class action lawsuit against Ancient Nutrition in March 2023 over claims the company falsely advertised that its “Brain Boost” brain health supplement would help with cognition.
