Ancient Nutrition falsely advertises its “Brain Boost” product in order to trick consumers—many of them elderly—into buying a product they are led to believe will help with cognition, a new class action lawsuit alleges.

Plaintiff Marietta Viera filed the class action lawsuit against Ancient Brands LLC (Ancient Nutrition) on March 23 in a New York federal court alleging violations of New York consumer law.

According to the lawsuit,  Ancient Nutrition sells a “Multi-Collagen Protein, Brain Boost” product that it purports is scientifically studied and is proven to be “brain-boosting.” 

The label on the back of the container identifies the “secret ingredient” behind the promise of increased mental clarity and concentration as an herbal cocktail trademarked as “Multi Collagen Complex & Brain Boost Blend,” Viera states.

However, according to the lawsuit, none of the ingredients in the product are scientifically proven to improve cognitive function.

“To borrow from mathematics, if none of the individual ingredients in Brain Boost can improve a consumer’s mental acuity, then consuming them in a single product will have no effect either. Simply put, four times zero is still zero,” the lawsuit states.

Ancient Nutrition falsely claims the product is ‘clinically studied,’ lawsuit states

To deceive consumers that the protein powder is backed by the rigors of scientific process, Ancient Nutrition falsely employs phrases such as “clinically studied,” “supported by proven research,” “backed by peer-reviewed studies,” and “tested for efficacy, safety and transparency,” to convey the false and deceptive impression that Brain Boost itself has been scientifically proven to deliver the benefits it claims, the lawsuit alleges. 

However, the product has never been studied, the lawsuit alleges. Instead, it is simply an “unremarkable vanilla flavored protein powder,” Viera claims.

“Ancient Nutrition’s advertising is very clearly designed to manipulate consumers with an appeal to scientific authority while, at the same time, concealing the fact that the ingredients in the Brain Boost protein powder are inefficacious and do not improve cognitive function.”

The plaintiff is suing on behalf of all New York consumers who bought the product. Viera is suing for violations of New York business law and seeks certification of the class action, damages, fees, costs and a jury trial.
