Chicago Cubs defeat claim Wrigley Field does not have enough wheelchair-accessible seating 

Last month, the Chicago Cubs beat claims alleging the team’s stadium did not have enough wheelchair-accessible seating options to comply with the Americans with Disabilities Act (ADA) following a 2014 remodel. 

A fan claimed the Cubs, during its 2014 remodel of Wrigley Field, which first opened in 1914, removed and replaced desirable ADA-compliant seating options with seats that have an obstructed view.

The Cubs, meanwhile, argued Wrigley Field has a total of 225 ADA-compliant seating options, the number required for a stadium of its size, and that its home field is more accessible than ever before. 

The judge overseeing the claims previously denied a Cubs request for summary judgment, determining at that time that filings submitted by the Cubs showed the stadium had only 188 seating options that were ADA-designated. 

Former MLB player claims Chandler Bats founder violated loan agreement with alleged trademark infringement

A pair of entities belonging to former MLB player Yoenis Céspedes filed a trademark lawsuit earlier this month against David Chandler, the original founder of bat company Chandler Bats, and Group Authentic.

La Potencia LLC and YC52 LLC, which are owned by the former MLB slugger, claim Chandler violated a loan agreement he signed by allegedly using the same method used to manufacture Chandler Bats to design and sell wooden bats under the brand “Authentic by David Chandler.” 

Céspedes became owner of Chandler Bats in 2019 after RxSport,  which originally  ran the brand, filed for bankruptcy. La Potencia acquired all of RxSport’s assets after the filing due to a $700,000 loan the former New York Met gave the company in 2017. 

Student athletes fight bid to dismiss claims Ivy League. its member schools undercompensated them

Earlier this month, a proposed class of student athletes resisted an effort by the Ivy League Council of Presidents and its eight member universities to dismiss claims they overcharged and undercompensated athletes by failing to offer them athletic scholarships

The student athletes argue they adequately alleged claims they were undercompensated by the Ivy League and its member schools, which are accused of using a now-discredited “amateurism defense” the NCAA used that the Supreme Court rejected in 2021. 

The Ivy League and its member universities are ultimately accused of engaging in a price-fixing scheme that works to raise the cost of education at the schools and suppresses student athlete compensation. 

The league and its schools, meanwhile, claim they are actually doing a good thing by not offering athletic scholarships, arguing not doing so helps increase competition and cultivates a culture of equality. 

Minor league baseball players push back against decision to dismiss MLB underpayment claims

A group of minor league baseball players pushed back at a magistrate judge’s ruling earlier this month to dismiss claims the MLB underpaid them and suppressed their bargaining power in an alleged violation of the Fair Labor Standards Act

The magistrate judge overseeing the proposed class action ruled the statute of limitations for the claims had expired and that MLB is not bound by antitrust laws

The players, who are attempting to reverse a 100-year-old antitrust exemption for the MLB, argue the league and its 30 organizations collude to restrict and depress the wages for minor league players. 

The MLB maintains it is protected from any competition claims thanks to its antitrust exemption status and cited the dismissal of a previous case a group of minor league teams that had their affiliations cut brought against it.

    USN No locks on service members “barracks rooms”. When on Deployment to Diego Garcia, I was detached to Masira, Oman. I was raped in my own room/bed while there in ’96 due to not having a lock. Recently found out that there are still no locks at said detachment site. How many more victims due to this! I reported and testified. Rapist found guilty,received 3 months in the Brig, an Honorable Discharge and supposed to register as a sex offender.
