A consumer filed a class action against Big Heart Pet Brands saying it falsely advertises Pup-Peroni contains real beef when the product actually contains feed-grade beef.

The Pup-Peroni packages advertise “Real Beef #1 ingredient,” “original beef flavor” and “no red 40 fillers” on the front and include beef as the top ingredient on the back, according to the class action. 

“The public expects beef is subjected to inspections to ensure quality attributes, such as (1) sourcing only from healthy animals, (2) limited use of additives and (3) careful review of processing methods,” the class action says.

Lower-grade meat requires more processing, leading to nutritional degradation, class action says

Feed-grade beef is lower in quality and requires intense processing, according to the class action. The processing leads to decreased nutritional integrity and can create potentially harmful substances like acrylamide.

The Pup-Peroni real beef claims led customers to pay a price premium of $3.29 for a 2.5-ounce package, which is more than customers would normally pay for the product, the class action claims.

The proposed class includes those in New York who purchased Pup-Peroni. The false claims are a violation of New York General Business Law and the New York Agriculture and Markets Law, the lawsuit claims.

The class requests monetary images, interest, attorneys’ fees and court costs.

Mid-America Pet Food faces a recent class action lawsuit claiming it was negligent in the sale of its Victor pet food that was allegedly contaminated with salmonella.
